For decades, there was no individual right to bear arms and no legal problem with gun control. It's literally only in the 80s-90s that the current interpretation of an individual right started to bubble it's way up through right wing. Even conservative justices have referred to this current interpretation as a fraud. There is nothing obvious about an interpretation that stops AR-15s from being banned or regulated.

That's because Scalia did some creative historical analysis and conflated the right to bear arms with the right to self defense and the right to have a revolution. All three are separate things. This whole thing about a "prefatory" vs "operative" clause is an inherently circular argument that was not taken seriously until a widespread information/misinformation campaign successfully convinced conservatives and then the American public that the whole militia thing was irrelevant.

Basically, the current interpretation is a result of a fixation on originalism, agenda driven amateur historical analysis, luck, and one side having extremely intense feelings about guns.

I agree that the second amendment doesn't guarantee access to all types of arms, but handguns have been established as a baseline in modern case law.

As for the idea that the distinction between "prefatory" and "operative" clauses was cooked up... there's plenty of evidence to the contrary. I'll grant you that the second amendment is unusual in the context of the Constitution, no doubt because it was a result of sloppy (but necessary) compromise. However, in the context of other law written at the time-- and the many state constitutions that followed-- the prefatory/operative distinction is well supported.

Great show. I loved participating in the speculation each week. Actually, it's one of the few shows that's dense enough that it's better-watched on a weekly basis than binged in a couple of sittings, imo.

Ultimately, I feel that some of the theories and speculation was more clever than what the show delivered. But it still delivered some great twists and set a very high bar for TV.

The militia is mentioned in a preambulatory clause. It was used as the primary justification for the second amendment at the time it was originally debated, but the right to keep and bear arms isn't legally predicated on it. If your goal is to ban all firearms then you're going to have to amend the constitution, plain and simple. The meaning of the second amendment is crystal clear in that regard.

MP3 has the most beautiful levels in the series, and the shooting controls (with Wiimote + nunchuck) are fun and feel great. It's the next best thing to having an arcade cabinet with a lightgun.

It's got satisfying lore too, with implications that go beyond just the Prime games (that tie into the franchise at large).

That said, the FPA elements take a backseat to the shooting and the level design is highly segmented. It's not the best Metroid game but it sets itself apart in some notable ways which make it worth checking out, imo.

There's no evidence that they rigged the actual election... yet. That's an important distinction. We knew, last year, that Russia attempted to gain access to private voter registration data. This year, we learned that Russia actually was able to gain read-access in dozens of major cities. Are you sure that's the end of it? I'm not.

Yeah, very similar scenarios have happened at my workplace too. Like, I would never have called one of my co-workers "sweetie" because it always sounded unprofessional and borderline condescending to me. But after seeing how a couple of them reacted when other people used that word... apparently it's a bigger deal than I originally thought.

I think it's part generational, too. The younger women in my office don't seem to care, but the Gen X-ers really hate that word, I imagine because there was a time where it was more commonly used with malintent.

There's been confirmation that Russia gained access to voter registration rolls. We can be relatively certain that they used this information to guide their social media campaign. It's yet to be determined whether they were able to alter the rolls. What's particularly concerning, though, is that reports of Russia's success have been upgraded a couple of times now... hopefully for the last time, but it could still be worse than we thought.

Yeah, like others have said... the platforming is relatively easy the entire game, except in an optional late game area. The difficulty curve is tied to the combat. Personally, I died A LOT to some of the bosses and felt incentivized to explore for items that would make me stronger.

Jimmy Buffet isn't best-known for his country songs and isn't primarily a country musician. He's written more country songs than some country musicians, but that's more a byproduct of how insanely prolific he is.

When the theme tries to come across as ominous with the brass though... the interval just doesn't work that way. That isn't the point. This movie was not deserving of the title at all. Very lazily added on that monster at the end for a few seconds to justify being a part of the Cloverfield universe.

I think that the scene you mentioned would have been more effective if the movie cut all of the Earth subplot and just stayed on the space station the whole time. The tie-in stuff hasn't done these movies a whole lot of good, from a purely critical/quality point of view. And I'll grant you that the marketing has been inconsistent and misleading at times. They clearly warned everyone that 10 Cloverfield Lane was going in a Twilight Zone direction, but Paradox over-promised when it claimed it would provide answers.

Still, if Paradox isn't deserving of the title, that's only because it doesn't live up to the high bar set by Lane, imo.

MP2 seemed like they gave their level designers free rein to make up whatever they wanted without providing compelling context. The design is brilliant but it feels contrived, like a game... not an organic world I could get sucked into.

MP3 has the most satisfying shooting controls (in terms of feel, not accuracy) I've ever experienced in an FPS/FPA. But yeah... the areas were totally disconnected. The environments were some of the most beautiful ever in a Metroid game, but it was lacking that satisfying feeling you get when you link back up to an area you've previously visited.

I'm getting close to what I assume will be "Ending C" and it's really really good. Nier: Automata takes advantage of the gaming medium's strengths in ways that have never been explored before, to my knowledge.

The gameplay mechanics have taken me for a ride. Automata seamlessly hops from genre to genre in ways that would sound crazy if I tried to explain it, and yet they all tie together and are thematically consistent.

Oh, and it's got the soundtrack of the year, easily. In fact, that's the sole reason I bought the game, and now it's almost an afterthought. Best blind purchase I ever made.
