SCOTUS has an effective national cap on punitive damages (damages beyond the amount needed to compensate plaintiff, intended as punishment for defendant) of 10x the compensatory damages. In this case, that would be 100 million. The jury decided to award 5 million. Virginia apparently has a hard cap of 350k.

This is correct.

Really weird that they awarded Amber anything, honestly, since they actively proved no damages whatsoever for Waldman's statements, but this is an enormous win for Johnny. This feels like a compromise decision though.

The primary issue of this trial was always how men who claim abuse are often laughed out of a building and not taken seriously at all. Most people were not taking this trial seriously at the beginning.

Let's focus on the fact that now male victims of abuse can finally start to be taken seriously and that people will think twice before lying about the most horrific crimes that you can accuse of someone and get away with it.

I think the victim winning will help other victims speak out. Abuse victims side with Johnny because Amber reminds them of their abusers. More people will speak up now.

In the end, Amber got her wish: Someone who spoke up against abuse violence was believed and not ridiculed.

It sucks that some terrible people will be galvanized by this decision, but Heard was so blatantly a physical and emotional abuser that I could never see the jury's decision as a mistake. I mean my larger point is that nothing about this trial is going to end up improving things for actual abuse victims, unlike some claims in this topic. A large part of society did not treat it with the seriousness it deserved, when you have streamers talking about how they went from single digit view counts for their gaming streams to thousands for live streaming the courtroom. It became a race to dunk on Heard for views, of such low tier analysis of courtroom proceedings. This is not a knock against Biscuit, he was mostly fair despite any bias and he sure as fuck isn't chasing clout on a dying video game character contest message board, but as a whole there's a reason The Onion made a dig at this whole thing.

I think there's a fine line between the trial itself and the verdict.

The trial was not something I took seriously and I took great pleasure in watching it because of how wild it was. This was the best new reality show in years. It was hilarious constantly and thus I was just watching it for the entertainment.

The VERDICT is a different thing. The fact that the victim triumphed over the abuser will give confidence to others to go forward. If they aren't going forward because of this trial, it may be because they don't have evidence and they now see how it works. But they still shouldn't be afraid to speak up like Johnny did.

Excuse me? Depp didn't meticulously document anything.

Amber was the one with meticulous documentation of staged photos and made up stories that she tried to fit conveniently in timelines where she claimed there were no witnesses. And she LIED.

Johnny just reacted in kind based on photos that existed through paparazzi. Amber lost because she had bad facts, not bad lawyers. Even if there was no Elaine, they still would have had a hard time winning.

Depp's team was great, absolutely. But to act like it wasn't an uphill climb to get to this verdict is nonsense given how hard defamation cases are to prove.
