The US is founded on ethnic cleansing of countless different cultures and it and many of it's major allies are actively engaging in ethnic cleansing as we speak. It's never been something we were very concerned with at all unless the country we are pretending to be morally outraged at is a political opponent.

At a glance, the only basis I can think of to challenge it federally is the republican form of government clause. I think you could make an argument that a state that invalidates 20 years of ballot initiatives on a stupid technicality no longer has a republican form of government. Probably not going to work though.
