Shielded from anything that isn't negligence basically. If they try, and you still get it. You can't sue.

Like the Marlins couldn't sue because they had guidelines and maybe they didn't work or the players themselves were the ones wrong, but it doesn't matter cuz there is a shield there because they did have efforts to stop it.

To be precise, it grants them immunity to COVID related injury/liability unless the plaintiff can prove with "clear and convincing evidence" that their injury came as a result of "gross negligence" on the part of the defendant. And even then, there's an out if the defendant was complying with government guidance.

Existing tort law has the plaintiff only needing to show their injuries "more likely than not" resulted from the plaintiff's "negligence" (not "gross negligence") and complying with government guidance isn't a back door escape card. McConnell's proposal goes well beyond the existing standards in this area.

I don't really like the sound of this as it seems to be endorsing ordinary negligence (something where a reasonable person would think the risk/reward ratio is bad). I mean, if the government is granting businesses immunity for ordinary negligence, maybe the government should pick up the tab for them if people do get sick.

I think we are really moving in this direction and we'll get there with one more term of Trump in office. Apparently the health insurance companies were so upset by his "socialist" executive orders that their execs didn't show up for a scheduled meeting with the President. But it's not going to happen without (1) a leader who believes in big government and (2) maximum pressure against the health insurance industry and their lobbyists.

(In other words, if Biden gets in, you can forget about it. Mitch will call it dead on arrival, Nancy will shrug and move on to other issues, Biden will say we fixed healthcare even though we didn't and completely ignore the issue).

Yeah this is common sense here. It's why they push every law known to man to depress voter turnout. Even if you think mail-in voting would cause fraud, their position on closing huge numbers of polling centers or gerrymandering the shit out of the country is clearly designed for voter suppression.

I mean, they know they're smaller than registered Democrats and Independents so any increase in voter turnout is bad for them.
