Batman's reason makes sense, depending on the continuity. I think this is from the DCAU, but I like the reasoning that since he's a vigilante, he has no right to play judge, jury, & executioner. He turns them over to law enforcement, & let's them decide. In that case, the fault lies with Gotham, for allowing them to live after every time Batman catches them.

Batman, despite being a vigilante who breaks the law every single day, really tries to follow the court of law when it comes to criminal trials and punishments. So barring the Gotham Courts sentencing him to time in the Phantom Zone, he wouldn't go for it.
