It does in Germany.

But you, in context, were referring to the US by saying the US has laws against speech does. It doesn't. At least not in the way you presented them.

darkknight109 posted...
And you'll note that the woman at the centre of this story is being sued by the police department, not charged with a crime.

Literally in the article.

The result of the altercation: preliminary criminal proceedings against the woman on suspicion of slander

darkknight109 posted...
More or less, yeah, actually. The 1929 German election was in essence the start of Nazism's true rise to power, and the country became a fascist dictatorship within a few years. By contrast, the laws you're objecting to have been on the books for decades and, last I checked, democracy in Germany is alive and well. I'm pretty sure if your alarmism on this was grounded in reality, something probably would have happened by now.

Not to mention, I suspect the atrocious state of Germany's economy in the post-WWI years and the frankly moronic decision by the allies to seek reparations from Germany had a lot more to do with the rise of fascism in Germany than libel laws, but that's me...

My 'alarmism' is only 'alarmism' when things are good. Germany hasn't had an enemy to fight recently, nor largely has the US. Their economy is strong and their people are doing well. But what happens when that isn't the case? What happens when their market crashes and people's lives ain't so good anymore? Maybe a dude has a crazy idea that the jews are responsible for the economic downturn. Can't call him a Nazi though, because that's illegal.

Also it's worth noting that it seems like the country is actively trying to erase their past by banning speech related to Nazism. I can certainly see why they would want to. But this seems like a bad idea in the long term.

I also want to point out that I'm morally against calling people Nazi's or racists. I think it's an incredibly stupid moniker for something that's rarely if ever the case. But I also don't want the government to be able to enforce my morality. I'd rather just call the woman a dumb bitch and move on with my life.

Yeah, sure, telling someone they're not allowed to slander other people is totally the most fascist thing you can do. Other than instilling a totalitarian state, fostering a militaristic culture, committing acts of political violence, conducting purges of the opposition, and exiling or murdering those who do not match a nationalist, race-centric model of "the ideal".

How the fuck do you think it gets like that? Does someone just pop in and say "LOL IMA PURGE YOU NOW"

It takes years of silencing opposition and ensuring no one can or will speak out against your insane ideas. Do you think Hitler just popped in and everyone was just totally cool with him killing millions of Jews?

darkknight109 posted...
But yeah, telling people they're not allowed to frivolously and baselessly make use of one of the darkest monikers in human history is totally comparable. I mean, it's not like the US has libel and slander laws, right? Because that would totes be fascist, yo.

Calling someone a nazi doesn't fall under the definition of libel or slander. Especially not for someone who is either A. a public figure or B. an authority figure particularly as it pertains to the government.

If that were the case, about 150 million people or more would be in a civil suit against Donald Trump.

Libel and slander are very difficult to prove. Moreover, libel and slander cases are fucking civil. Not criminal.

Nice strawman argument, but you completely missed my point.

Whether you agree with Germany's laws on free speech or not (and, for the record, I never voiced my opinion on the matter one way or another), implying that a country is fascist because you're not allowed to call someone a Nazi is a completely ridiculous equivocation.

Infringing on someones free speech is like, the most fascist thing you can do to someone short of putting them in jail or murdering them. If they can't say what they want, they might as well not exist.

you could try to make that argument but i don't really think it'd get really far or become a reality. it doesn't stop anyone from filing civil suits or anything.

You can file legal suits all you want. And I would have encouraged this kids family to do so. However, I have a big problem when it comes to setting precedent in criminal matters especially as they pertain to speech.

You think it doesn't happen, but this kind of shit goes down the slippery slope all the time. "Give them an inch and they take a mile" has never been more true when it comes to legal cases. For instance, with these rules, I could pretty easily justify that you had a hand in Sunny's suicide if he were to kill himself.

This kind of shit already has laws that are in place to prevent it. If a person is being chronically harassed, they can file a restraining order. If they're being harassed as a child, they should be going to their parents/school about it and let them handle it.

What if, in a similar case, a kid says he's going to kill himself and you just say, "I don't care" then the kid proceeds to kill himself.

Should you be held responsible?

True.

The problem in this setting is that although technically since they are both in Italy, they aren't breaking any laws.

But they are both American and clearly the laws there are different. What about the older man's upbringing? If he grew up in America then he'd certainly know that getting intimately involved with a teenager is illegal in his country. It would/should also make him emotionally uncomfortable.

So with that said, he'd be legally and morally conscious (from his American POV) that sleeping with this teenager would be illegal/immoral were he in America, but nuts to that since he's in Italy(?).

Hmm.......from that perspective, I'd feel a bit weird watching it.

Interesting little tidbit. Sex tourism is actually illegal as a citizen of the US. If someone were to book a trip to Thailand for the purpose of doing their pervert shit with a minor, they and anyone who helped facilitate could get busted for trafficking.
