The plan:

  1. Apply to a bunch of in-office jobs all over the US that can be done remotely
  2. Telling the interviewer that I have an autoimmune condition that prevents me from leaving the house for almost any reason (no grocery store, bank, gym, walks, etc)
  3. When they say "oh sorry this is an in-office position," remind them that they're required by the ADA to make reasonable accommodations for people with disabilities, and in this case remote work is a reasonable accommodation
  4. Tell them I'm recording this conversation and I'll report them to the EEOC for disability discrimination if I believe they've discriminated against me on the basis of my inability to go into the office


"but you said you could work in the office/you would relocate" yes, unfortunately i couldn't answer your application questions truthfully without opening myself up to illegal disability discrimination. does that sound like a defense? your honor, he lied when we asked him a discriminatory question?

"we've decided to go with other candidates blah blah blah reasonable doubt reasonable doubt reasonable doubt" you realize that employment discrimination is a tort, not a crime, right? so the standard of evidence is way lower? and i just have to convince a judge that it's more likely than not that my inability to go into the office is juuuuust a little bit relevant to your decision? and i have a recording of all this back-and-forth where you're trying to defend a discriminatory position?

I am, but I'm not limiting my search to jobs that are offering remote work because they have lots more applicants and 99% of jobs are in-office, even chat-and-email jobs for some reason.

you do know if this actually went to court you would have to prove your claim with doctors testimony/written testimony, right? all the job would have to say is that they aren't hiring you for recording without their consent anyway. you can't actually go to court if you are lying about not being able to work remotely lol

That sounds expensive and risky. If I were telling the truth, all I'd have to do is email the phone call with all the hemming and hawing and back and forth about the work location to the EEOC. Then the company's lawyers have to convince the judge that actually none of that stuff mattered at all and their non-discriminatory reasons for denying me the job were totally for realsies the only relevant ones. Also if I were to take them to court and win, they'd have to pay me damages for discrimination, then hire me remotely anyway, then pay me back pay for the time I missed, then have the federal government go through all their policies and handbook to make sure everything is compliant and probably do a bunch of training and stuff.

I'm pretty sure that it's illegal to demand accommodation for a disability you don't have.

It's also guaranteed to get the interviewer to dismiss you immediately. You don't ask for accommodations until you have the job. They can discriminate against you by not hiring you and just say you were a poor fit. You can't prove why you weren't hired, after all. And if you make demands during the interview, they'll think it's all about you and not hire you accordingly.

I'm not going to actually sue but that's whistleblowing. Firing people or denying them employment for whistleblowing is also super illegal. This is why I'm limiting my search to one-party consent states

if you actually start threatening someone during an interview they absolutely wouldn't just take your word that you are unable to work on site...you would have to prove it. either way they would for sure deny you employment for trying to pull that kind of move, no one is hiring someone who shows up to an interview threatening them lol your best bet is to just try and get the job you want like everyone else does

Failure to hire is a civil matter, not criminal. The standard of proof for a civil matter is basically 51%. I wouldn't just instantly bust out the legal stuff, I would give them enough time to dig a hole where it was really obvious that this was the actual reason. And then "btw jsyk what you're doing is textbook disability discrimination"

No I wouldn't. Basically the only way I'd have to pay anything is if I were found to be maliciously prosecuting or something. The EEOC's lawyers handle all of that for me.

If this scheme of yours would actually work, don't you think that a lot more people would either be in their dream jobs and/or filthy rich from suing these companies?

You forget that if this were to go to court, civil or otherwise, of course they're going to get confirmation from your doctor. Who is no doubt going to say "Um no, they are not restricted to home working" after which the entire thing will fall on your head as this is the basis of your legal action
