Except self defense has to be reasonable. She was dragging that thing along and didn't look like she could much damage anyway if she connected. Someone with a far better understanding of physics could probably explain it better.

And he went straight for a head shot which could be argued as going too far.

Like yeah she was aggressive and yes she did pick that huge thing up but with how she was struggling, he could have and should have defended himself in a less potential death inducing way.

How TF was he supposed to know she couldn't lift it? Someone comes at you with a weapon, you don't just stand there and do nothing.

She was clearly threatening and started to swing the thing at him, it's ridiculous to act like he's supposed to wait to see how hard she can hit him with it before he defends himself from an obviously telegraphed attack coming at him.

Basic physic knowledge?

As for the second part, I literally said he should have defended himself.

My point is that self-defense laws would be murky since you aren't supposed to go too far, which this looks like he did.

Right. If someone has a weapon, unless it is completely and totally obvious that they can do nothing to harm you, as if they were a small child with a fork, your priority is self defense. The same principle as shooting center mass.

I never said he should wait for him to hit her, why the fuck are people thinking I said this? Or that he should have defended himself.

The way she grips the thing in a batter stance there is no way she could have hit him in the fucking head. Which is what he did.

She was the aggressor. She was at fault. He had every right to defend himself in a legal manner. Going straight to head like he did I don't think would be covered in a self-defensive manner due to it not matching the level of violence she could have done. That's my whole point.

Are people actually responding to that Kastrada's ridiculous post seriously?

That's full grown adult with mal-intent gunning straight at another person wielding an object capable of dealing serious damage. His first instinct was to immobilize the threat as quickly as possible while maintaining his physical being intact.

Going too far would be him continually striking with equal or greater force after they've been incapacitated and no longer and immediate danger to his persona.

Pretty cut and dry.

Whether she can lift it doesn't matter. Reasonable force is a thing. My friend was in a fight that at first was self defense however he ended up kicking dude in head and went to prison for felony assault. This guy could easily face the same

She had a stick, he had a board.

Additionally he was clearly backing up giving up ground while she advanced, despite what I would say was a clear body language from him that he didn't want to but would use the board to protect himself. Then she still made a move that by the video looked like she was ready to take a swing which he reacted to. At least in that small video she's clearly the aggressor.

What I'm wondering is what the hell happened to lead to this though? Why does he have a board and why does she have a giant stick coming at him? How did we get to this point?

He hit her ONCE and then stopped when she wasn't a threat. So that really doesn't apply here.

Again, since people are putting words in my mouth, she was at fault and he should not have waited until being hit and had every right to defend himself within reason.

Also this is New York City that doesn't have a stand your ground law.

My point is looking at her attempt to pick up that thing with two hands. It's pretty obvious she can't lift that thing to hit him in the head with the same force he hits her with. That's just physics.

And this is the part where you are putting words in my mouth. I'm not saying he should have waited to be hit at all. I've said before he had a right to defend himself because she was the aggressor in this situation.

But legally speaking, especially where this is, I don't think he has the self-defensive protection when he hit her in the skull with a blunt object.

The way she is dragging the thing and how she picks it up, it's weakly held.

In New York where there is no stand-your-ground law. Where self-defense laws, with weapons involved, is weaker than other states.

And I think NYC is a duty-to-flee place or whatever it is. Where self-defense is even weaker if you don't take the chance to leave a volatile situation like this.

And I'll repeat:
She was the aggressor.
He has the right to defend himself.
Women can abuse men.
Men have every right to defend themselves.
This specific situation, in the location they are in, based on the laws that govern that city makes me think he went above the legal definition of what would constitute self-defense there.

I'm going based on fucking New York law which is weak compared to other states.

www.nyccriminal attorneys.com/self-defense-criminal-lawyers/
(Delete the space)

New York is not a stand your ground state. It has a duty to retreat law in place

Duty to retreat means that a person must attempt to avoid a violent situation before they respond with force to defend themselves. Most states do not have a duty to retreat when it comes to using nonlethal force in self-defense, but many do have a duty to retreat before a person can legally use lethal force to defend themselves.

So the thing would be was he actively avoiding the situation prior to hitting her? Would his walking backwards constitute retreat under NY law or not because I honestly don't know.

But it's not a clear cut self-defense situation based on where they are and the fact weapons are involved.
