She was armed with a weapon that can easily maim or kill. He was, too. She approached him in a threatening manner and was dropped, without him continuing a beat down. That is reasonable.

That is as equivalent as something gets. She was going to strike him with a wooden stick. He struck her first, and only once, with a wooden stick. Equivalence is not even required under New York law, only that the attacker was imminently going to use deadly force, which a brandished weapon and threatening advance covers, and that the defender had a reasonable fear for their life. I think most people would reasonably fear for their own safety and life in a situation where a grown adult was walking at you with a wooden stick with the obvious intent to strike you with it. At the very least, I can't imagine convincing all twelve people of a jury that that's not self-defense if it actually went to a trial--Which it wouldn't, because the prosecutor would not likely bring it to court on such a flimsy basis.

The only leg you have to stand on is that New York is a Duty to Retreat State, which only permits the use of deadly force if retreat is not an option. That does NOT mean that you have to first fail to retreat in order to use deadly force, only that there is a reasonable belief that retreat would not immediately remove the threat of death or imminent bodily harm. Considering she was aggressively approaching the man, one can argue it would be a reasonable belief to continue to follow him if he tried to retreat. Without additional context to the situation, it is not something that I can really answer with any certainty.

Here is an example stationary of the juror instructions given to decide on self-defense cases in New York. It confirms everything I just said.

As well, the fact that the defender only struck the aggressor once then retreated when it was obvious she was incapacitated is a fairly conclusive statement on the state of mind of the defender. Any decent defense attorney could use his behavior as evidence that he was an involuntary participant in this attack and demonstrate no criminal intent to cause bodily harm beyond self-defense.

My compassion for people ends when they consciously create situation that actively endanger other people's lives. It picks back up about the time they stop being a threat to other humans. The period in between is the jurisprudence of the Law, not my personal feelings.

I've already addressed that. The way she picks that up does not look like she can hit him in the head. She isn't showing me she is strong enough to get that high. That was just on first watch.

I do not think that woman, based on how she was handling that weapon, could have killed that man in the video.

He hit her to where she could possibly have died.

I do not think that is a fair use of defense.
