Ridiculous to charge someone who preys on another person's addiction and sells unregulated, toxic substances to them?

With murder? Yes. Because it isn't murder.

It is.

2502. Murder.
(a) Murder of the first degree.--A criminal homicide constitutes murder of the first degree when it is committed by an intentional killing.
(b) Murder of the second degree.--A criminal homicide constitutes murder of the second degree when it is committed while defendant was engaged as a principal or an accomplice in the perpetration of a felony.

Title 35, 780-113 (a)(30)

(30) Except as authorized by this act, the manufacture, delivery, or possession with intent to manufacture or deliver, a controlled substance by a person not registered under this act, or a practitioner not registered or licensed by the appropriate State board, or knowingly creating, delivering or possessing with intent to deliver, a counterfeit controlled substance.

(f) Any person who violates clause (12), (14) or (30) of subsection (a) with respect to:

(1) A controlled substance or counterfeit substance classified in Schedule I or II2 which is a narcotic drug, is guilty of a felony and upon conviction thereof shall be sentenced to imprisonment ned in and the profits obtained from the illegal activity.

(1.1) Phencyclidine; methamphetamine, including its salts, isomers and salts of isomers; coca3 leaves and any salt, compound, derivative or preparation of coca leaves; any salt, compound, derivative or preparation of the preceding which is chemically equivalent or identical with any of these substances, except decocanized coca leaves or extracts of coca leaves, which extracts do not contain cocaine or ecgonine; and marihuana in a quantity in excess of one thousand (1,000) pounds, is guilty of a felony and upon conviction thereof shall be sentenced to imprisonment not exceeding ten years, or to pay a fine not exceeding one hundred thousand dollars ($100,000), or both, or such larger amount as is sufficient to exhaust the assets utilized in and the profits obtained from the illegal manufacture or distribution of these substances.

(2) Any other controlled substance or counterfeit substance classified in Schedule I, II, or III, is guilty of a felony and upon conviction thereof shall be sentenced to imprisonment not exceeding five years, or to pay a fine not exceeding fifteen thousand dollars ($15,000), or both.

(3) A controlled substance or counterfeit substance classified in Schedule IV, is guilty of a felony and upon conviction thereof shall be sentenced to imprisonment not exceeding three years, or to pay a fine not exceeding ten thousand dollars ($10,000), or both.

Edit: in summation, someone died because of a felony you (dealer) committed, therefore 2nd degree murder is the proper charge.

The murder wasn't committed during a felony. The felony was selling the drug. This did not result in any death. Drug buyer went home and OD'd. No death occurred during the act of a felony. Those laws are put in place in cases of a botched robbery (a felony) resulting in someone's death you nimrod. Hence the language: a homicide WHILE the commission of a felony.

People who sell drugs shouldn't be tried for murder. The fuck is wrong with these prosecutors? It doesn't even fit the definition for murder. I'm sure nobody gives a shit about charging a liquor store owner who knowingly sells liquor to an alcoholic. But i'm sure people on here will act like they're tough on criminals for fantasizing about killing drug dealers.

That's just school shootings, not all mass shootings. What is a mass shooting to you, more than 2, evidently. Guess I can't directly refute that, but to me, you need more.

Also, will a psycho that can't get a gun find another method every time?

I'm not a psychologist, but if you're mentally unstable enough to want to kill people that badly, not getting a gun isn't gonna stop you.

Nor am I, but people who are mentally unstable enough to want to commit suicide are more likely to do so if there is a gun in the house. That says something, I think.

Post research of this statement. Many of the country's with the top suicide rates in the world have some of the most stringent gun control, and they simply have a different primary means of suicide. So what you are basically saying is that you have a problem that people opt to choose a relatively painless way to die as opposed to other ways.

Wow, strikingly unimportant statement!

If your statement was accurate, explain why the highest guns per capita in the WORLD is #48 on the list of suicide rates. Because according to your twisted logic, more access to guns means a higher chance of suicide no?

https://en.wikipedia.org/wiki/List_of_sovereign_states_by_suicide_rate

Can you tell me where I mentioned gun control?

http://www.foxnews.com/health/2014/01/21/gun-ownership-tied-to-three-fold-increase-in-suicide-risk.html

Suicide has to have several factors to occur. Having the means does not mean suicide will happen.

In other words, guns do not cause people to kill themselves.

No kidding. But guns will make it more likely. Australia's suicide rate dropped dramatically. Why do you have so much trouble acknowledging well-known facts? Your argument is basically "There are people who own guns that don't kill themselves." No shit. It reeks of desperation.

FL needs some serious changes for gun buying, there is a reason they have you fill out forms and get checked before they will sell you anything in many states for a good reason.

I love guns but background checks, and paper work are something I agree with as no one with mental issues, a criminal background, or a juvie record of violence should ever have a gun.

Lol, first attempt at making an analogy and failing miserably. Good try though with your utterly falacious comparison.

Explain how my analogy is a failure

Because knowing whether or not a soup is not supposed to have flys or fecal matter in it is a simple non-ambiguous issue. Knowing whether or not a police killing is justifiable is a complex issue that requires more than just a glance.

Sometimes it requires literal teams of higly knowlegeable expert investigators years of debate and inquiry to reach a consensus about a particular incident, if one can even be reached at all. It takes no actual training to identify instantly that a bowl of soup isn't supposed to have flys in it.

I don't think it takes that much to tell that killing someone is bad. That's something we teach children in elementary school

I think it takes a lot considering the entirety of society has granted law enforcement the right to kill people in justifiable manners. But keep pretending all cops who kill people are bad.

Not all of them. Just the ones who kill those that aren't trying to kill them. Self defense is valid. Preemptive killing is not.

Lol a guy pointing a gun at a police officer or someone else and a cop shooting that person before that person has a chance to fire absolutely is valid.

Where in the article said he was pointing a gun at them?

It's incredible that a developed country can even say that. Only a gun nut thinks that "The majority of mass shootings kill less than 5 people" being a good case for keeping guns so loosely regulated.

You said the pressure cooker attack wasn't that bad because only 3 people died

Most mass shootings don't have greater than 3 fatalities.

Come on bro, focus on the argument at hand.

Pressure cooker bombs are still much more difficult to make than buying a gun. If people would just as easily use pressure cookers, why don't those attack occur in developed countries like Australia? It's clear most psychotic people aren't going to go through much hassle. The hassle alone cuts down on the amount of mass killings if guns are unavailable. As we've seen in countries that have banned semiautos.

I just wanna point out that your comparison is flawed. Immigration changes would stop the perpetrators of violence, a gun law would only make a tool harder to acquire instead of stopping the perpetrators.

Depends on how you look at it.
My point is reduction through increased difficulty. In that way, it's an apt comparison.

A psycho who wants to kill people and can't get a gun will use other things instead, like a truck or a pressure cooker bomb.

You mean the pressure cooker bombs that killed 3 people in Boston? Yeah those things sure are as deadly as guns that kill dozens in minutes.

The majority of mass shootings have fewer than 5 deaths.

Does that include gang and drug violence?

No

https://en.wikipedia.org/wiki/School_shootings_in_the_United_States

Even not counting the cases with no fatalities, there's extremely few cases where a mass shooter kills more than 3 people

It's incredible that a developed country can even say that. Only a gun nut thinks that "The majority of mass shootings kill less than 5 people" being a good case for keeping guns so loosely regulated. Like jesus christ. Imagine someone saying that without a pinch of irony. A mass shooting by FBI definition is the killing of 4 or more people. So I'm not sure what definition you are using to claim that it's usually less than 4 people. You fabricate things as you go, eh?

And this may come as a shock, but I own firearms. I conceal carry 99% of the time. So I'm not a "gun-hating liberal." I just also happen to have a grasp on reality.

Teachers leaves gun in desk. Student grabs gun. Shoots someone.

The gun should be in their person at all times. And students shouldn't be told which teachers have guns. That should remain confidential for obvious reasons. You didn't think this through much did you?

So it should remain on them at all times....yet remain hidden....ummmmm where am I putting the gun as I teach? Up my butt?

You have literally never heard of concealed carry? Lmao do you know anything about guns?

Where is it going to be concealed?

On your person. Hence concealed carry. I feel like I'm speaking to a toddler.

Lol at all you edgelords having a problem with people saying "thoughts and prayers"... what the fuck? It's no different than other sayings meant to show sympathy. Do you get mad when people say to sick people, "I hope you feel better". Hardly anyone takes these things as having literal changing power, and of those that do, even fewer believe the changing power these words possess are sufficient without actual action. If that were the case, we never would've made it out of the stone age.

Because after the 50th time it no longer sounds like a means to show sympathy but as a recycled phrase to be repeated ad nauseam while not being willing to do jackshit about it.

To you, maybe, but in reality, what are most people to do? Ban guns? Enact "reasonable gun control?"The problem with that is that "reasonable gun control" is defined entirely by liberals, and will inevitably lead to total ban of guns, which is what they want. If that's what you mean by "doing Jack shit about it" then you bet your ass I will never get behind that. Some things, such as the ideas this country were founded on, are far more important, and far bigger than any one man, or family. Some great things have bad, indirect results.

Damn liberals actually want to do something about it and complain about OUR thoughts and prayers??
