NOTE - I'm not suggesting going after gay marriage is correct, moral, or anything. It is obviously horrendous. I'm thinking of worst case scenario and SCOTUS act like amoral crackpots, there will still be safehaven for gay marriage.

If we want to be very generous (which yeah, isn't quite deserved) back when the court was only slightly conservative, they did rule in favour of protections on the basis of sexual orientation (I want to say 2020?).

The argument of "you aren't wedding two people of the same gender when you would if one of those people were the opposite is quite literally gender-based discrimination" does still hold here, and was a recent enough decision the court would in theory need to justify why its okay there but not here.

Its not going to matter, but literally the current court has its own specific precedent against their own obvious expected decision here.

The shortest answer I can give you is that state legislatures have been primed, like abortion, through old statutes that were never taken off the book about gay marriage (I think they're the same as "trigger laws"--stuff just waiting for SCOTUS to say "states' rights" and states saying "got it covered"). And where they haven't been primed, there's too many legislatures controlled on the state level by republican majorities or supermajorities, and a SCOTUS states' rights ruling will be a de facto ban because... of course republicans will write new bans.

It's like how if civil rights were left back in the hands of the states, lunch counters would instantly be segregated again (if lunch counters existed, but you get the point).

ive never been married and am ignorant but i assume there are reasons to want your marriage federally recognized (tax reasons, complications in states that dont recognize your marriage, etc)

Tbf, this isn't about how people voted in 2024. It was people in 2016 who either voted Trump or decided they didn't need to bother voting for Hillary. That put Trump in position at just the right time to appoint 3 Justices and flip the Supreme Court 6-3 conservative.

I wish that I could adequately explain how pissed I am. I knew it was coming, but just the raw frustration of knowing that I'm about to have one of my rights stolen from me while half of the country cheers for it is just too overwhelming for words.

If you leave it up to the states, that's the kind of thing that will lead to a mass exodus. Reciprocal recognition of almost all marriages has become the norm over the last decade.

Half of the country is going to become no-go zones for certain groups of people. The very thing they accuse other countries of. Rural states get rewarded politically in such a scenario.
