If we were getting a lot of 5-4 decisions with one of the conservative justices joining the liberals in dissent, that might be the case, but we have been seeing a lot of cases in which the liberal side actually wins because at least 2 of the conservatives join them.

Switching Ginsburg for Barrett of course still makes a big difference because you are replacing one of the most liberal justices for one of the more conservative ones. But she's turned out to be probably less conservative than Alito and Thomas, and I recall she was hyped up (on both the left and right) as an incredibly right wing judge. And in the world where Reinquist holds on until he is replaced by Obama, so that instead of Roberts, we have a left wing justice, that would probably result in an even bigger shift.

Affirmative action is dead.

Universities are going to have to actually try to come up with alternative acceptance criteria instead of just giving handicaps depending on race which really should be a good thing for everyone if their goal actually is diversity.

Spoilers every time a college has eliminated their diversity program a massive drop in black enrollment has occurred.

I mean the case for Affirmative Action is obvious, but I will just remind plum that majority opinion has not ever and should not ever be the basis of specific policy because most people dont actually know what theyre talking about. Especially in cases like this where its so easy to alter opinion based on phrasing and detail provided.

I don't think this is a reverse racism situation (which are usually stupid)

Rather the group primarily hurt by affirmative action are Asians so it's just regular old racism.

Also those stats about black enrollment roll over the pandemic. My guess is the pandemic making everything harder influence that tremendously

While this is true, the last thing you want to do is to make a strong stand against the majority on a topic that is ancillary to your overall goal.

If we get public education gutted entirely for instance because the far right runs against affirmative action and morons go along with it, it is bad for everyone.
