If we were getting a lot of 5-4 decisions with one of the conservative justices joining the liberals in dissent, that might be the case, but we have been seeing a lot of cases in which the liberal side actually wins because at least 2 of the conservatives join them.

Switching Ginsburg for Barrett of course still makes a big difference because you are replacing one of the most liberal justices for one of the more conservative ones. But she's turned out to be probably less conservative than Alito and Thomas, and I recall she was hyped up (on both the left and right) as an incredibly right wing judge. And in the world where Reinquist holds on until he is replaced by Obama, so that instead of Roberts, we have a left wing justice, that would probably result in an even bigger shift.

I mean, Alito and Thomas have a lot of lunatic decisions. Managing to be to the left of them isn't exactly an accomplishment.

Universities are going to have to actually try to come up with alternative acceptance criteria instead of just giving handicaps depending on race which really should be a good thing for everyone if their goal actually is diversity.

Affirmative action decision was 6-3, no surprises on who voted where. (Technically two cases and KBJ wasn't on one of them so more like 6-2, 6-3 decisions)

Majority opinion has some twisted reasoning like, "We gave colleges 20 years to fix representation with affirmative action and they didn't completely fix a systemic issue completely in that time? It's gotta go."

And also embracing the zero-sum "reverse racism" shit with "They said race could only be a plus to someone's application but if you let more minorities in then that means less white people get in so actually it's a minus for them!"

Also, buried in a footnote, Roberts exempts military academies from this decision because he actually acknowledges it could be problematic if the officers are racially disproportionate to the rank-and-file so the military academies may continue to apply affirmative action.

Which sure seems "curious" when it kinda feels like you could make that exact same argument to the case at large given the importance of a college degree in employment.

I still can't get over Roberts admitting that racial disproportion is a problem and college admissions should be able to take action on that... but only for the military.

It's the weirdest thing. It's like for a few sentences he is making the case for affirmative action but then quickly gathers himself and goes, "No, wait, it doesn't matter. The military can keep doing it because I already wrote that down but thankfully I caught myself before I accidentally joined Sotomayor's opinion."

While this is true, the last thing you want to do is to make a strong stand against the majority on a topic that is ancillary to your overall goal.

the notion that it's just "reverse racism" and "just as bad as racism" has been prevalent all my life, so the arguments against have done a tremendous job of marketing themselves to the masses.

Doesn't mean those arguments aren't full of it.

Some progress is better than no progress.

Can't stop doing something good just because it isn't something perfect (which doesn't exist).

But I suppose that's the point. Can't fix anything you don't support if you lambast it for failing the impossible standard of perfection.

As we approach 20 minutes until the fate of student loan debt relief (and maybe some LGBTQ rights) are given to us. Twitter has apparently decided to now prevent users without an account to even view tweets anymore. I mentioned how, as a not-user, they had been slowly eroding the ability to use the site since Elon took over but now it's finally hit the stage where even trying to view a tweet is disallowed and instead redirects you to a register notice.

Oddly, embeds still work.

On the LGBTQ front. 6-3 party line ruling that the First Amendment can't require a wedding website designer to make ones for gay marriages. This is the case where it turns out the website person may have faked her "injury" by creating the man she claims asked her to make a website because when contacted by journalists he said he never heard of it and was married to a woman at the time of the complaint.
