Im not well enough versed on specific senate rules so please feel free to correct me, but is this true? Everything I had read before was that things could only be included in reconciliation bills if allowed by the senate parliamentarian.Yes, the parliamentarian's ruling can be overruled by the presiding officer (the VP in this case since Harris would be sitting in this for tiebreaking purposes.) You can also do what the GOP did back during Bush 43's term and just fire the parliamentarian and get a new one because you don't like their rulings. While I am not certain of the exact process here in terms of what motions could be filed in response, I would assume such a decision could be challenged by a full vote of the Senate. The reconciliation process itself, as outlined by Congress's 1970s legislation that created it, allows for the parliamentarian to be overruled by a 60 vote threshold but I think (key word here, not positive) that overruling the presiding officer were they to step in would simply be a majority. So, yes, hypothetically a presiding officer (or a parliamentarian even) could just start allowing anything by claiming it follows the guidelines for reconciliation even if it obviously doesn't. When the Senate started the reconciliation process a few weeks ago they already committed to it being a reconciliation bill so the 50 vote requirement is already locked in. A presiding officer overruling the parliamentarian in such a manner here would be tantamount to eliminating the filibuster of course, though technically speaking would not actually do that. As LotM mentions the "can only be used up to 3 times per fiscal year" requirement would still be in place due to the fact that the reconciliation process itself was created by that 1970s law but yeah, hypothetically you could do all this. As a practical matter though, if Harris were to do so, it would almost certainly fail. Assuming I'm correct that such a ruling could be challenged (and it's almost impossible to believe it could not) you'd need 50+VP to uphold the ruling of the chair (Harris) on the matter which means you'd need all the Dems to commit to this and there's basically a 0% chance Manchin would play ball. I'd fully expect him to side with the parliamentarian/Republicans vote against it defeating it 49-51 (if not more if say Sinema joins him too, etc.) Fundamentally, it's the same thing as during the first impeachment trial where Roberts was presiding over the Senate. Chief Justice of SCOTUS serves as the presiding officer of the Senate for impeachment trials of a president so he'd be filling the exact rule as Harris would be here. He can make his rulings, but as discussed back then, they are all subject to a vote of the Senate so back then the GOP could have overruled Roberts or been put in the tricky political position of whether they would want to. It's why Dems were hoping Roberts would make rulings on certain matters but he never did. The chair/presiding officer has the ability to issue such rulings but it's largely ceremonial because at the end of the day it's the Senate itself that makes the final call by voting on it. It's just the presiding officer is almost always a member of the majority party (only in a 50-50 split with an opposite party VP present in the chamber would they not be) and a lot of these details are worked out beforehand so everyone tends to go in on the same page. --- xp1337: Don't you wish there was a spell-checker that told you when you a word out? ... Hopefully he's just staying around for the end of this term (SCOTUS terms start in October and run through until usually June/July) so his vote is still around for the cases they have, which include quite a few big ones still like the ACA one.

Biden beat Trump by 40,000 votes where it actually mattered. To equal or better that, another Democratic candidate would need to A. match Biden's name recognition, which the vast majority of the field did not do, and B. neither depress Democratic turnout, nor boost Republican turnout. This country sucks and again, is highly conservative, and I just don't have faith in anyone but Biden to thread the needle of peeling off enough conservative voters that would otherwise just vote for four more years of Trump.
