The FBI has released 2 photos of a suspect they want to question about the murder of US Capitol Police Officer Brian Sicknick who they believed was the one responsible for tossing the fire extinguisher at him!!

They have yet to confirm whether the officer in that video was Sicknick who was struck in the head as he and his colleagues faced off with hundreds of Trump supporters who stormed the capitol

The FBI is asking anyone who may recognize the bearded man to call investigators immediately

Steven D'Autuono, the head of the FBI Washington Field Office said "It's an ongoing investigation. We're looking at everything. It cuts us to the core that one of our brothers past away. There's a lot of tools and interviews we're still conducting."

Dailymail released the disturbing video of a MAGA rioter seen throwing the fire extinguisher and another picks up the extinguisher and tosses it at cops.

Sickick is seen managing to walk away from the melee before collapsing hours later at his division and went to the hospital where he was placed on life support before being declared dead a day later

President Trump had finally ordered the flags to be half mast to honour the fallen officer but has yet to CALL the family to offer condolences

Sicknick was an ardent supporter of the President as it is surprising he has not yet called the family

Sad but if he did it he needs to face prosecution. It's one thing to hold strong beliefs but it's quite another to let that boil over and end in someone getting hurt. I guess people learned nothing from Charlottesville a few years back.

My take is that every single person who unlawfully entered that building that day is an accomplice to that murder, and should be charged to the fullest extent of the law.

There is no 3rd degree murder in either the US Criminal Code or the D.C. Criminal Code.

In addition, the felony murder rule may apply, kicking this back up to 1st degree murder.

Yeah, I voted 2nd degree murder b/c 1st seemed unlikely.
But then I keep forgetting how damn wide of a dragnet "felony murder" can entail*.
I've disagreed w/ felony murder for a long damn time, but it is the law, and it's these "tough on crime" and "blue lives matter" morons that support such strict laws. So fuck 'em! These terrorists deserve whatever charges they get.
I think technically every single person that went to the riots could be considered complicit in the murder, if the prosecutor was vindictive enough.

* For example, it could be a group of unarmed burglars robbing a house w/ no intention of physical altercation only for the owner to awaken and shoot one of them dead, and then under felony murder rules, ALL of the people involved in the crime are "murderers" for engaging in a crime that lead to someone being killed, even though none of them fired a shot and it was one of them that died. Even the getaway driver chilling in his car outside is legally a "murderer". There have been cases just like this, and they were indeed found to be "murderers".

The terrorist attack was planned in advance.
The murder that occurred in the act of that crime thus falls under "felony murder" and probably could be 1st degree murder since the crime that led to the murder was planned. Felony murder is crazy.

But the thing is, felony murder is bullshit. It makes murderers out of people who are not actually killers.
Felony murder lets prosecutors charge people with murder if someone dies, even by accident, if they were committing a dangerous felony at the time of the death. The underlying felony has to be dangerous enough that someone dying, even by accident, was foreseeable.
A common application of felony murder is when a group of people plan a robbery and someone dies. Even if the death is accidental or one of the perpetrators is killed by a cop. It doesn't matter what role you played in the underlying felony, or even if anyone was armed.

Because the crimes were committed in DC, federal law applies. The federal felony murder rule, found at 18 U.S. Code 1111, says people can be charged with murder if they:
"committed in the perpetration of, or attempt to perpetrate, any arson, escape, murder, kidnapping, treason, espionage, sabotage, aggravated sexual abuse or sexual abuse, child abuse, burglary, or robbery; or perpetrated as part of a pattern or practice of assault or torture against a child or children; or perpetrated from a premeditated design unlawfully and maliciously to effect the death of any human being other than him who is killed, is murder in the first degree."
Armed insurrection, riots, and terrorism are, for whatever reason, not on the list.
That doesn't mean it would be impossible for anyone to be charged with felony murder, though. According to former federal prosecutor Tim Heaphy,
"You could look at the storming of the doors of the Capitol by that riotous mob as burglary. If they went in with the intent to steal, disrupt proceedings, to commit other offenses, they committed burglary. And, therefore, a murder that occurred during the course of a burglary could be potentially charged as felony murder."

TL;DR: Felony murder is fucking crazy and should go away. But it exists and is on the books, and is used regularly to fuck over people, and these terrorists committed these acts w/ felony murder on the books, so...
