Also would be okay with this method of handling the case where the Senate and President cannot agree. The Senate is required to have an up or down vote on the President's nominee. If rejected, the Senate must name an alternative candidate, whom the President can either approve or veto. If there is no agreement after the President and Senate have each proposed two nominees, the President and Senate can each select one of their two picks to run in a national election in which states are allocated votes according to the formula used for the Electoral College.

It is that all of the votes cast in Philadelphia and Pittsburgh which were counted without Republican observers being allowed close enough need to be thrown out. That's 450,000 ballots. Apparently, once the mail ballots are removed from the secrecy envelopes there is no way to link the votes back to the envelopes to determine eligibility. There is thus no way to effectively recount them to identify fraud at the eligibility stage. Rudy's proposed solution is therefore to throw out all of the ballots opened without R observers being close enough.

I have no idea what they're even talking about. I'd argue Georgia has been one of the most transparent. Unlike Arizona or NC, there were literally giving us several updates per day about the exact counties with outstanding votes and even THE EXACT number of votes left in those counties.

I'm sure he's done terrible things elsewhere, but out of all the slow states I feel like Georgia has been the best at this.

I really don't think Trump was ready to lose Georgia or Arizona. Their entire post election strategy has been to demonize "democratic" states so they could focus on the "OBVIOUS" fraud in Pennsylvania/Michigan and hope to have the courts overturn the results.

This argument is a lot dumber when you have Georgia with republicans at all levels of government going "uh we haven't seen anything here". It is also probably why he was so mad at Fox for their early Arizona call. Another state that has republicans at all levels of power.

Oh, I see. This is regarding them getting to move from 10 ft to 6 ft.

The problem with that was that despite the court ruling to let them move closer, if there had been actionable violations in the first place, which they were absolutely trying to argue at the time because the whole point was to stop the vote count in Pennsylvania, that would have come up in the ruling. The fact that they already went to court over this already completely works against them.

(Not that it would have ever worked, mind you.)

The observation is a separate issue from the alleged fraud. They got an appellate court ruling that they were to be allowed closer not based on any evidence of fraud but because they have a right to observe. But that ruling did not come down until midway through the count. Now they are using the fact that they did not get that access until midway through to count to try to create an inference that there was fraud during the unobserved portion of the count.

The normal counterargument is: well, why didn't you seek access earlier? And their response is that they did but the trial court erred in initially ruling against them. The appellate court already found the trial court erred on that, and hundreds of thousands of ballots were counted before the appellate court had time to consider the case. The errors of courts must be fixed, but how can you fix this one? This is probably exactly what Team Rudy was hoping for. Because they know full well there was no fraud on a massive scale, but now they have an argument to throw out 450,000 votes, which would produce a net swing of around +300,000 to Trump.

Also, this is why the PA secretary of state was so careful on instructing the counties to segregate the mail ballots received after election day. Because she anticipated that not doing so would trigger an attempt to throw out ALL the mail votes. Now, the proposed remedy of disenfranchising half a million people is so outrageous that I can't imagine a court will go for it - but at least it is possible to make an argument for it.

I don't think that is true. Well, I mean it is true there were 17k reported more that came in, but at least according to the site I use there was also a drop of 20k added to the totals (sorry - I got the numbers there swapped). The actually margin changed on NYT too.

What I don't know is what these votes were.

We have an update from Alaska, which now says there are 157,209 uncounted ballots up from 134,664 yesterday (the difference is likely explained by the fact that absentee ballots are still trickling in). That makes Bidens and Grosss path to winning a little bit easier, though it would still require an impressive comeback. Biden needs to win more than 67 percent of the outstanding ballots, while Gross needs to win more than 68 percent.
