Johnston's Riot Act (pre-revolution) is amazing. It made it a crime for a group of 10 or more people to fail to disperse within 1 hour of being ordered to do so (whether or not the assembly was peaceful). That may not seem so bad, but the law also provided that anyone could be charged by having their name posted in town, that failure to appear to make a defense constituted an admission of guilt, and violating this law carried a mandatory death penalty. Worst of all, it applied retroactively, effectively sentencing people who had previously participated in a perfectly lawful protest to death.

I almost feel like a lot of the Bill of Rights used this act as a model of what needed to be banned.

Also, if Bill Barr is going to try people for sedition, I think it would be much better if instead of trying ordinary citizens for sedition, he puts Hillary Clinton on trial for lese majeste. Her comment calling the American People "deplorable" and "irredeemable" is classic lese majeste - insulting the sovereign, which in this country, is the People. So I will say, allowing the same person to occupy multiple offices simultaneously is how the Roman Republic ended. For the first 300ish years of the Roman Empire, "emperor" was not a real legal office. The legal fiction was that the emperor simultaneously occupied all of the high offices of the Republic.

Yes, that is the principle. I mean that's very logical right? If the People want the Senate to approve the President's nominees, they would vote in a Senate of the same party. If they don't want that, they vote in a Senate of the other party. Seems very logical.

Even if the 2015-2017 Senate had adopted the Biden Rule, that decision is not binding on any subsequent Senate. I donated to the DNC this week. And I will donate to them every election year for so long as I live. They know they're going to lose. That's why. Mitch will be safe in his seat as Trump gets voted out. He may lose the senate. Can the filibuster be removed in case of a tie broken by the VP? Just cause even Biden is giving overtures of their being consequences if Republicans vote in a justice before or after the election. But the most likely scenario is a divided Senate. Republicans losing 4 seats and Dems losing 1.
