President Donald Trump signed an executive order targeting social media companies on Thursday, days after Twitter called two of his tweets "potentially misleading."
Speaking from the Oval Office ahead of signing the order, Trump said the move was to "defend free speech from one of the gravest dangers it has faced in American history."
"A small handful of social media monopolies controls a vast portion of all public and private communications in the United States," he claimed. "They've had unchecked power to censor, restrict, edit, shape, hide, alter, virtually any form of communication between private citizens and large public audiences."
The executive order tests the boundaries of the White House's authority. In a long-shot legal bid, it seeks to curtail the power of large social media platforms by reinterpreting a critical 1996 law that shields websites and tech companies from lawsuits. But legal experts on both the right and the left have raised serious concerns about the proposal. They say it may be unconstitutional because it risks infringing on the First Amendment rights of private companies and because it attempts to circumvent the two other branches of government.
"(Trump) is trying to steal for himself the power of the courts and Congress to rewrite decades of settled law," said Democratic Sen. Ron Wyden of Oregon, the architect of the legislation that the order seeks to reinterpret. "He decides what's legal based on what's in his interest."
The ordermarks a dramatic escalation by Trump in his war with tech companies as they struggle with the growing problem of misinformation on social media. The President has regularly accused sites of censoring conservative speech.
On Thursday, Trump acknowledged that legal challenges to the order are on the horizon, saying he was "sure they'll be doing a lawsuit."
"I guess it's going to be challenged in court, what isn't?" he asked. "But I think we're going to do very well."
A draft of the order, which was reviewed by CNN, targetsa law known as the Communications Decency Act. Section 230 of the legislation provides broad immunity to websites that curate and moderate their own platforms, and has been described by legal experts as "the 26 words that created the internet."
It argues that the protections hinge mainly on tech platforms operating in "good faith," and that social media companies have not.
"In a country that has long cherished the freedom of expression, we cannot allow a limited number of online platforms to hand-pick the speech that Americans may access and convey online," the draft order says. "This practice is fundamentally un-American and anti-democratic. When large, powerful social media companies censor opinions with which they disagree, they exercise a dangerous power."
On Tuesday, Twitter applied a fact-check to two of Trump's tweets, including one that claimed, without evidence, that mail-in ballots would lead to widespread voter fraud. Trump immediately shot back, accusing the social media giant of censorship and warning that if it continued to offer addendums to his messages, he would use the power of the federal government to rein it in or even shut it down.
The draft order also accuses social media platforms of "invoking inconsistent, irrational, and groundless justifications to censor or otherwise punish Americans' speech here at home." It also faults Google for helping the Chinese government surveil its citizens; Twitter for spreading Chinese propaganda; and Facebook for profiting from Chinese advertising.
Facebook, Google and Twitter declined tocomment.

The problem is that at some point while growing up, people that act like trump need to get their ass kicked. Someone eventually fucks their shit up and they learn a bit of humility and decency.

His rich daddy protected him from that so he never really fully developed as a person and is more of a bratty 13 year old when it comes to his behavior and the way he views the world.

I've long said the same thing of Karens (way before that meme even existed; holy shit are entitled middle aged white women the absolute worst customers). Because they're female, born into middle class or better, and formerly had looks, they grew up w/o anyone ever calling them out on their shit or had any of their abusive behavior lead to the threat of an ass beating.

This seems weirdly off base. So Facebook self regulates and removes misinformation campaigns? Thats their right to do that as a private entity. If anything, these groups have a bigger argument for censorship than Trump does. And even then, if they want to sow misinformation and theyre proven wrong, why would they be surprised at being removed when the entity in question clearly desires to remove it.

I'm not entirely sure what the issue is? Right now people can sue newspapers for carrying content produced by other individuals. Youtube can be sued for DMCA violations despite merely facilitating the act. Why should social media platforms have greater protections?

All things considered, this is a pretty massive cry from the level of regulation that I've long expected social media would face from the government.

I don't support Trump. But I do like balanced opinions on my social media feeds. If the tables were turned and it was liberals getting censored from Twitter or Facebook, I could guarantee there would be more snowflakes melting on the left side than the right.

I stopped using Twitter for this very reason....the problem is that millions still do. And when it we are faced with finding facts, or gauging public perception, you still have millions of Twitter idiots being swayed to the left side, because the right isn't getting fair representation on what most people thought was an open platform.

So you might think it's a simple matter of 'not giving Twitter' your business. But your vote is being suppressed by those who are ill-informed all the time.

This executive order was bound to happen, either by Trump or the next guy anyways.

My first impression was that it is trying to undermine section 230, but now I'm seeing that he's revising how 230 is applied...

I will hold my opinion because I don't understand this very well. Who can tag a lawyer? I don't actually care if it came from a Trump tantrum if it actually enforces some kind of free speech laws on Twitter.

the literal wording of section 2 meants that you lose your section 230 rights if you moderate or alter posts, unless you meet a very vague test for the content counting as objectionable. basically what it would do if implemented is provide the doj with a cudgel to attack social media sites that arent nice to whoever is running the executive branch, since you can't reasonably run a web forum without moderation, the test is very open to interpretation, and it allows the executive branch to dictate the application of the test through the FCC. this would likely cause the large internet companies to flee us jurisdiction.

i think it wont amount to much, since trump was so clearly & explicitly operating in bad faith that even modern day judges wont allow it

The funny thing about "Private Companies can do what they want" argument is that it's not a rock solid shield to fall back on. There are "loopholes" in the system where Private Spaces can be utilized for Public Use; POPS (Privately Owned Public Space). Granted it only applies to public parks and other open spaces BUT it allows the public to maintain their rights within these private properties.... How this applies to the virtual space is not yet known (until now) because the internet is always an ever changing environment, old crusty lawmakers always have a hell of a time catching up.

Trump's executive order is a sign of things to come, when these "private companies" claim to service a public platform, they need to follow the rules and rights of the land no matter what. Facebook, Twitter, even here on gFAQs "should" be allowing free speech, as long as the speech isn't hateful or a call to physical violence (as the law states).

But if I want to talk about (like in the video I posted) "Trans-people in Female Sports", or "WHAT WERE THE VOTING DEMOGRAPHICS IN BRITISH COLUMBIA DURING THE 2019 ELECTION (RIGHT MODS!?!!?)".... I shouldn't have to be moderated to protect one side of the political spectrum.
