41 y/o Iraq War Veteran, Andrew Demma who only got 1 DAY IN PRISON for watching 4000 images and videos of CHILD PORN after arguing it's cause of his PTSD will now be RE-SENTENCED as the 6th Circuit found the punishment "unreasonably low"!!

He plead guilty in 2017 to possession the images and videos of adult men raping and sexually abusing underage girls

He secured a single day sentence after 3 psychologists said his addiction to child porn was a result of Post Traumatic Stress Disorder he got after 2 tours as a medic in Iraq

One psycho said his actions were "directly resultant from experiencing the ravages of war as this impacts children"

Another had said the child porn he watched since 2010 were because they were bringing "pain to himself" to redo within his mind the pain he experienced in Iraq

Similarly, Judge Walter Rice said his law abiding life, military service and low risk of re-offending made his case "rare"

Instead of a lengthy prison sentence, he was ordered to pay 45,000 to 9 victims and to be supervised for 10 years and do 100 hours of community service as well as drug testinga nd counseling

The Dept. of Justice said there's no evidence to support the position that military veterans who suffer PTSD will become addicted to child porn and the 6th Circuit agreed as it will be sent back to Ohio for re sentencing

Ironically, Demma once held a job where he spoke to children who were SEXUALLY ABUSED but never told them that HE suffered similar abuse after stating "I wasn't abused..i can only imagine".

Second, what kind of dishonorable fuck blames his PTSD for his clear and unrelated vices.

But he was already sentenced. Yes, it was a BS sentence but we cant just keep trying folks for shit after theyve already been sentenced. Im just concerned with precedent.

And another thing... paying a fine for porn charges seems wrong, it's like the Judge is a pimp and he's just collecting... if there's 9 confirmed victims he should have gotten the standard, what is it, 7 years? *9... so 45 years, with some of those being concurrently served based on behavior

there are people out there who are paid to watch child porn day in and day out who could claim ptsd because they are paid to do so in order to find out who those kids are then there are guys like this who blame ptsd for his viewing of child porn personally i think he should be sentenced to life and be castrated at the same time and no im not talking about chemical either.

I get what you're getting at, but I don't have a porn collection. I literally just go to a website any time I want to see one. I don't even have any family photos on my computer, I'm a pretty solitary guy.

These people are different though, they are criminals heavily hunted online. I'm guessing they probably just download big packets of pictures/videos at one time off hidden website not browsing and picking and choosing stuff leisurely the way you can with non-criminal porn.

All stories about pedophiles like this mentions them having "thousands of images" so it's just become kind a normal to hear. It really, REALLY, doesn't make sense to me that they would count each frame of a video as a separate image.

It acts on the presumption that the legal system was corrupted. It means all cases this effects were dodgy to begin with, so if it's handled badly again, it's still no worse than where you started.

Given what he must have gone through during service and the above, I think this is fair and for the best. 10 years supervision, if he re-offends, he'll be caught, and they can crush him to the full extent of the law then. As it stands now though, the stern warning of fines, community service, supervision, and counseling are a better option than simply throwing his life away with no option to redeem himself or better the world in any way.

I'd be more okay with the initial sentence if it included treatment for the PTSD. I can believe that it manifested itself in this way, but if that's the story they're going to accept, they need to see that through and ensure that his disorder won't harm anyone again. Supervising him for a decade isn't going to fix his PTSD.

My understanding is that they count every single copy as one image, so if someone makes a backup of a picture, that's now counted as 2 images, even though they are identical. And if they use indexing software that makes a thumbnail database (like Windows), that's another copy. So someone could have a much smaller collection but then because there's a backup and thumbnails of the original and the backup now there's 4x as many images.

The more "images" the suspect has, the more likely a jury is to convict and the longer the sentence they're liable to give.
