You have no freedom of speech on a private platform. For now. I can see this changing, and yes, that would be constitutional. As it is, you could never compel a platform to curate or not curate certain content. That's a constitutional non-starter. You can restrict their immunity to liability for content delivered through their service. Section 230 can be repealed or modified, and I see growing political will to do so. If we added a requirement that platforms must behave impartially to material that doesn't break the law in order to maintain their immunity from liability, we would see one of two things happen: freedom of expression would be the defacto standard on all internet platforms, or all platforms would become heavily curated "walled-gardens" with zero user content: which would be the end of all social media. You are completely free to start your own video sharing website and make up whatever rules you want for it. If Youtube's censorship is truly as onerous as you're implying, the free market should support you all the way. Kungfu Kenobi posted... For now. No, it wouldn't be, because it would likely violate the First Amendment. Part of the First Amendment's protection is that the government cannot compel speech from you. If I do not want my platform used to magnify certain messages, the government cannot force me to air those messages over my own objections. Notably, this has business implications beyond the liability you're zeroing in on. Let's say I'm Google and I'm in a battle for eyeballs against other tech giants. Suddenly, a group of white supremacists start using my site to air their shitty views and word of that gets out to the media. At that point, I have two options - kick the fuckers off my site, or tolerate them and risk having the rest of my non-shitty users switch over to a different platform that is more willing to keep white supremacists and other forms of human trash away. If the government forces me to keep those people around, it's going to hurt my bottom line. As a business owner, I should not suffer because the government wants me to broadcast messages I do not support and which are actively harmful to my business. --- Kill 1 man: You are a murderer. darkknight109 posted...You don't have to fight it at all. So you're saying they're a public utility then? Doesn't that mean the government's going to have to nationalize them? Sounds like an awfully left-wing idea coming from you. Anyways, unless and until that happens, yes, Google is a private company and nothing more. They owe no greater commitments to their consumers than any other private company. Their terms of service are quite clearly spelled out, and you clicked the "I agree" button when you scrolled past them while creating your account. I have absolutely zero sympathy for anyone who loses their Youtube privileges for ignoring those rules and getting the consequences that they were explicitly told about when they signed up for the 100% free service.
