Tbh, it looks like I'm alone here, but I think this is the right call. Giving individual states the power to remove candidates from the ballot like that would just lead to chaos. We were already seeing Republicans starting bad-faith efforts to remove Biden from the ballot in their states because of some extremely twisted logic comparing the "border crisis" to an insurrection against the country.

And it was a unanimous decision anyway. The liberal justices agreed with the conservative ones on this.

My issue is the majority went further than necessary and essentially gave authority for enabling enforcement solely to Congress. I think the Sotomayor/Kagan/Jackson concurrence has the right of it.

As an aside, I am inclined to think that Roberts was the primary author of this one. It doesn't read at all like a Thomas or Alito opinion. Maybe Goresuch instead of Roberts, but I'm also not familiar enough with Kavanaugh's writing to rule that out.

I get that somewhat, but the "Old No. 7 Brand" part is technically part of that logo, and then underneath that, right above Coca-Cola, it says Tennessee Whiskey. Like, you have to ignore a lot to ONLY see the Coca-Cola logo.

The only thing that piqued my interest was the bit about the motion to disqualify. Now that was fucking hilarious. If calling a spade a spade warranted disqualification, the majority of judges, if not all of them, would be disqualified in criminal trials because sentencing necessarily requires the judge to explain the justification for the sentence, which frequently amounts to using a lot of words to convey that the defendant is a piece of shit.

That's not how they will rule. They will rule exactly like in 2000 for Bush that only Trump has immunity and no other president can use this ruling because it only counts this one time.

Unfortunately, there is a workaround over global application to all other presidents. If the Court finds that all the election shenanigans fell within the ambit of the "official duties" of the office, it has its out to limit the scope of the decision.

I wouldn't expect the oral arguments to be fun for Trump or his lawyers.

This is where I'm at. I don't think this is something that the Court would want to not thoroughly address. I'd love to say "dismantle" instead of "address," but an affirmance is not carved in stone despite all historical traditions indicating otherwise.

These people don't understand how the appellate standards of review work. Most cases that get high publicity in appellate courts concern constitutional questions, which are full blown questions of law that get de novo review (basically a blank canvas for the appellate court), so most people think that appellate courts will just willy nilly reverse a trial court's decision.

Most of what the Trump team will be appealing from is subject to clear error review, which requires a showing that there was basically no basis for the trial court's decisions/ruling.

As Engoron's order plainly shows, there is ample evidence to support his findings. I also heavily doubt that any evidentiary or procedural errors would be so prejudicial as to warrant a reversal of the judgment.

My dad's 74. He's still mobile and mostly together. His short term memory has gotten more than a little bad, and there are things he can't really do anymore (like use a razor blade to shave because he can't see well enough, although that's more due to macular degeneration than just getting old).

The extent to which his properties are already leveraged likely creates some additional difficulties in securing any kind of loan as well.
