As an aside, I am inclined to think that Roberts was the primary author of this one. It doesn't read at all like a Thomas or Alito opinion. Maybe Goresuch instead of Roberts, but I'm also not familiar enough with Kavanaugh's writing to rule that out.

The only thing that piqued my interest was the bit about the motion to disqualify. Now that was fucking hilarious. If calling a spade a spade warranted disqualification, the majority of judges, if not all of them, would be disqualified in criminal trials because sentencing necessarily requires the judge to explain the justification for the sentence, which frequently amounts to using a lot of words to convey that the defendant is a piece of shit.

I wouldn't expect the oral arguments to be fun for Trump or his lawyers.
This is where I'm at. I don't think this is something that the Court would want to not thoroughly address. I'd love to say "dismantle" instead of "address," but an affirmance is not carved in stone despite all historical traditions indicating otherwise.

These people don't understand how the appellate standards of review work. Most cases that get high publicity in appellate courts concern constitutional questions, which are full blown questions of law that get de novo review (basically a blank canvas for the appellate court), so most people think that appellate courts will just willy nilly reverse a trial court's decision.

Most of what the Trump team will be appealing from is subject to clear error review, which requires a showing that there was basically no basis for the trial court's decisions/ruling.

As Engoron's order plainly shows, there is ample evidence to support his findings. I also heavily doubt that any evidentiary or procedural errors would be so prejudicial as to warrant a reversal of the judgment.

My dad's 74. He's still mobile and mostly together. His short term memory has gotten more than a little bad, and there are things he can't really do anymore (like use a razor blade to shave because he can't see well enough, although that's more due to macular degeneration than just getting old).
