A person commits the offense of contributing to social transition if the person is acting in his or her official capacity as a teacher or school counselor and the person provides support, regardless of whether the support is material, information, or other resources to a child regarding social transition.

  • The offense of contributing to social transition is a class E felony.
  • As used in this section, the following terms mean:
  • "Child", a person under eighteen years of age;
  • "Social transition", the process by which an individual adopts the name, pronouns, and gender expression, such as clothing or haircuts, that match the individual's gender identity and not the gender assumed by the individual's sex at birth


Tier I sexual offenders, in addition to the requirements of subsections 1 to 4 of this section, shall report in person to the chief law enforcement official annually in the month of their birth to verify the information contained in their statement made pursuant to section 589.407. Tier I sexual offenders include:

  • Contributing to social transition under section 566.400;

So a teacher calling a student by their preferred pronoun will be charged with a felony. If convicted, they must register as sex offenders, which obviously means an end to their teaching career. And for posterity, I'll remind everyone that the American Medical Association, the American Academy of Pediatrics, and the American Psychological Association (i.e . the experts) all recommend gender affirming care for transgender children.

Rarely will Missouri recognize constitutional rights of a protected class before the federal government forces it to. This seems pretty extreme of a penalty for simply not using the pronoun assigned to a student at birth so I'd hope it wouldn't get through or at least not in the current format, but I wouldn't be shocked if it did either.

Missouri doesn't see trans rights at protected the same way other classes, thus not giving trans people the same constitutional protections. If anything, I almost feel like this would be better pitched as a free speech issue as far as the US or Missouri Constitutions would be concerned.

I do wonder if the bill would be strictly applying the use of a certain pronoun as amounting to providing non-material support for social transitioning, especially when the punishment is losing the right to vote and having to register as a sex offender. It's worded very conveniently ambiguously, but obviously is problematic whatever way it would be applied.
