There's always the possibility that the prosecution deliberately held it back for future litigation.

Prosecutors do that sometimes, when they're worried that they're not going to be able to win. Same reason why they'll occasionally try violent crimes separately (ie, have three separate murder trials rather than a single trial with 3 murder charges). The idea being that, if you do win on the more severe charges you don't need to pursue the lesser charge, but if you lose on the major charge you can still bring the lesser charge forward later.

Then again, there's also the argument that, if the shooting itself was not a crime, then by definition crossing state lines with a gun is not a crime either, because it isn't illegal to cross state lines with a gun in and of itself. You'd have to prove intent to argue the case, and intent clearly wasn't proven.
