Also just to add, if this helps out the Democrats more in the future, Im all for it. I just hate how dishonest some people are with their justification for it lol

I legit hope it happens at this point, just because itll give more power to the democrat party when it comes to laws and stopping insane Republicans, and literally no other reason beyond that. I dont have some weird fear of the SC as it is right now, and I wont pretend that I do have

I agree, I don't really give a shit either way about packing the court, but I hate to see bad and/or ignorant arguments where the premise is flawed and the conclusions don't follow

Fun fact: most bills attempting to increase the size of state level supreme courts in the past 10 years were proposed by Republicans. The only ones that succeeded were Republicans.

But expanding the size of supreme courts is tyranny by the Democrats or something

@Samurontai I didn't say that the scotus can't declare things unconstitutional, what I said is that the fact they haven't ruled any EOs unconstitutional is irrelevant because they don't get to decide arbitrarily what laws or policies are unconstitutional. That is why, like I said, none of trump's had even been heard by the scotus at this point in 2017.

Read this to understand why the argument you've been making, that eos are about "numbers not time" is ignorant: https://www.uscourts.gov/about-federal-courts/educational-resources/about-educational-outreach/activity-resources/supreme-1

Maybe Im arguing a non issue, but Im specifically talking about the SCs ability to outright deem an EO unconstitutional

not their procedures to deal with a federal judges block

But rather, their ability to not have to wait for a federal judge to deem it so, but the ability to jump the shark I guess I could say

Actually, youre right. Ill admit I was wrong in that the SC cant outright block an EO

but even so, Biden has been able to push through most of his policies relatively unchallenged, outside of the pause on the 100 day deportation thing earlier this year

so packing the courts is still a non issue, and only being done for optics, much like the 15 dollar minimum wage push from earlier (not that this was a non issue but more so that it was mostly optics)

what do you mean by 'most of his policies'

you realize that thus far the only relevant legislation passed was the coronavirus relief bill right? and that it was passed without filibuster, and with zero republican support, only by using the democrats' once-per-year reconciliation tool?

it's quite clear that democratic party leadership does not support packing the courts because it would involve taking risk, yes.

so, is he not facing resistance, or is he not rocking the boat by trying to do things too fast? also was the coronavirus relief bill produced very fast?

you need to understand that he is always facing universal resistance from 49.5% of the senate voting body.

so any progress is going to have to be that which can be passed by the slimmest possible majority, even if that majority was elected by 80% of voting americans.

We should up the court size. And the Supreme court shouldn't be small enough that one president in one short 4 year term can completely **** up the country's judicial branch for an entire generation just because he has some luck and a senate who went out of their way to **** over the previous administration.

Hea pushed out more executive orders in his first week than the past 3 or 4 presidents iirc. Im not saying hes doing things too fast, because thats subjective, but rather that hes rocking the boat regardless.

Also the relief bill had to go through Congress, and its hard to gauge quickness in relation to other bills due to the nature of it, and what it was for, so I cant answer whether it was very fast or not

I could've sworn Joe Biden said he wouldn't pack the court dozens of times while campaigning.

He actually didn't. He threatened to do it multiple times then demurred whenever asked by not really giving an answer. Hence during the campaign people kept accusing him of literally trying to do this -- or using the threat of doing this -- to undermine SCOTUS as an independent agency. And if there's one thing that authoritarian regimes like the Biden administration hate, it's independent bodies that won't just go along with anything they want.

America is in a very, very dark 4-12 years (since, although Biden claimed he wouldn't seek re-election, he still might and, with SCOTUS in his pocket, he could remove presidential term limits, so he very well may be president for 20 years or up until the day he dies)

My proposal for the Supreme Court was to expand it to 19 Justices and rotate 2 out every Presidential Election Cycle. This keeps the formative goal of independence from the other branches while also avoiding the 'existential crisis' antics surrounding how and when Justices get appointed.
