The reason they have to be physically present is the quorum requirement I think. Incidentally, what would happen if, say, the Republican members of Congress met at their party retreat and declared it was a session of Congress. Then they vote through a bill to ban all abortions with no exceptions. No one observes the absence of a quorum in the House and the bill is passed by unanimous consent so no roll call vote is taken.

Can the courts strike down the new law for being passed without a quorum? I'm not sure that they can.

That said, I'm not sure that what I described above can't happen under the current rules. Because I don't think it's a requirement that Congress meet in the capitol building or in DC even. I'm pretty sure Congress evacuated DC during the War of 1812 (the British soldiers held a mock meeting of Congress when they took it) and Congress wasn't considered prorogued or unable to meet.

No, I meant the Defense Production Act itself. Under what constitutional provision is the President allowed to commandeer private businesses? Commerce Clause seems wrong because there's no commerce being regulated. If the President can order commerce created and use that as grounds to get within the CC, it seems like a completely meaningless limitation. Germany commandeered private businesses for its war effort and we called it fascism.

Big businesses no, but we should probably do something about smaller ones. Local restaurants and bars are going to be devastated by this and I don't think that's something you can fix by simply cutting everyone bigger checks. And I think at least part of the bill is for that purpose.
