Yeah. This one is extremely common. If you so desperately want that internship that you are willing to do it without pay....you can't complain. Simple as that.

No it isn't. A bill passed in March 2018 changed that.

tip pooling is not illegal in the US

and honestly boh employees should get some percentage of tips because theyre busting their ass and most diners are tipping based on their overall dining experience

Only if the wait staff is being paid minimum wage before tips. If they are being paid less, which many restaurants still do, they can only be required to share it with other employees making less than minimum wage.

The kitchen staff usually get paid more because you can find anyone to serve the food, but you need to have a decent cook to make people want to eat there.

So tip pooling is fine if your waiters and cooks are all making minimum, but waiters are allowed to be paid much less than minimum under the assumption tips will cover it. If the tips do not cover the difference management needs to pay out, so some places go with a tip pooling system that allows them to make sure all the servers are getting over minimum instead of paying it out of pocket. This helps the servers who are on a slower shift, or who had to take less charitable customers so is generally seen as positive since it can help anyone.

But if you include the kitchen into that pool as well you are basically using the servers and busboys wage so you can save a few dollars on the kitchen.

If they are all already being paid minimum wage it is not as big of an issue because all the tips are just extra and not something needed to make their wages.

im glad I live in australia where tipping is seen as an abberation and not the norm as we are award wages case in point when i used to work at Mcdonalds I was earning around $24 dollars an hour before taxes at the adult wage as a crew member but having said that we also have one of the worst cost of living because of our wages.
