The jury began deliberating in the murder trial of former police officer Amber Guyger on Monday.
The jury was instructed to decide whether Guyger is guilty of first-degree murder. If found not guilty, the jury should then consider a lesser charge of manslaughter.
The defense also rested its case Monday in Guyger's trial for killing Botham Jean in his Dallas apartment in 2018.

Not really. But, from what I understand they are saying she let him die by not using her first aid kit and giving enough aid. Thus, it was intentional? Idk. First degree murder doesn't make a lot of sense tho.

The Difference Between Manslaughter And Murder In Texas
Blog

When one person dies as a result of another persons actions, that is always considered a homicide. However, there are various kinds of homicide, not all of which are illegal (i.e. self-defense), with varying degrees of repercussions.
Criminal homicide cases are divided into two different charges: murder and manslaughter.
To help you understand the difference in Texas, weve detailed each below:
Murder

Murder charges are further divided based on the severity and other circumstances surrounding the crime. While many states separate murder charges into first and second degree murder, Texas law makes a distinction between capital murder and murder.
In order to be charged with murder, the defendant must have knowingly and willingly caused the death of another person. The biggest distinguishing factor between murder and manslaughter involves the intent of the perpetrator. If the defendant intended to cause serious bodily harm or death, or intended to commit a felony other than manslaughter that resulted in death, he or she can be charged with murder.

Manslaughter
Many states have two different forms of manslaughter: voluntary and involuntary. Texas, however, combines these two charges into one and has enhanced penalties for certain aggravating factors.
To be convicted of manslaughter, a defendant must be proven beyond reasonable doubt to have recklessly caused the death of another person. As opposed to murder, intent does not need to be proven in order to convict someone of manslaughter.

For reference, Texas doesn't have first/second/third degree murder. It has Murder, Manslaughter, and Capital Murder, where Capital Murder applies when the victim is an LEO, general "Felony Murder" situations, the perp was paid for the murder, murder of somebody under 10 years old, and a few other conditions I'm too lazy to double check at the moment.

All of that said, holy shit the system works for once. God fucking bless that jury doing the right thing.

That's hella tricky. She obviously meant to kill the person. But, she meant to kill the person due to accidental reasons.

Manslaughter here seems to fit the best. Recklessly causing the loss of life.

On the other side, it's messed up for someone obviously to lose their life just sitting at home doing nothing wrong but watching TV. A punishment is definitely required, but I would think it makes more sense to not ruin 2 lives over 1 accidental mistake also. So, I would expect a more lenient sentencing on the murder charge, if possible.

Right but even in castle doctrine in Texas the use of deadly force has to be both reasonable and necessary. You have to establish self-defense, which also means not being the instigating party. So without any de-escalation or reasonable threat, the intent to kill is just murder.

Which is absurd, because cops should be held to higher standards, but I'll take the victories we can get. Especially when they're local to me.

Yeah, the legal question seemed to be whether incorrectly believing yourself to be in your own is enough to invoke the castle doctrine

It's like self defense clauses. When you kill someone in self defense, it's still murder. You're not contesting that. The onus is then on you to prove the murder was justified, and different states have different criteria for that

The jury has to interpret any force used as reasonable unless the state proves it otherwise beyond a reasonable doubt, said Pete Schulte, a Dallas-based lawyer.

According to Schulte and Fort Worth law firm Barnett Howard & Williams, a person can claim self-defense if:

- They believed someone was on their property illegally.
- They reasonably believed the deadly force was immediately necessary.
- They did not provoke the person against which the deadly force was used.
- They werent engaged in criminal activity (other than a minor traffic offense) at the time the deadly force was used.


Honestly, I think the jury went down the list and found her guilty by the letter of the law.

I'm aware there is racial subtext, but I believe the jury was doing their best to be impartial
