Supreme Court, that is...

An unusual neighborhood dispute between a vegan and meat-eaters ended up in the Supreme Court of an Australian state, according to reports.

Cilla Carden, a vegan massage therapist from Girrawheena suburb of the city of Perthwas angry with the fish and meat smells coming from the barbecue in the her neighbors' back yard.

"They've put [the barbecue] there so I smell fish, all I can smell is fish. I can't enjoy my back yard, I can't go out there," Carden told Nine News Perth.

Health-conscious Carden has also taken issue with neighbors smoking cigarettes in their garden, because she says the fumes waft into her back yard. And, Carden says, she is fed up with the neighbors' children playing basketball and making noise.

"They just bang the wall anytime that I've been sleeping. Their kids with the basketballs, just banging... it vibrates this part of the house. It's been devastating, it's been turmoil, it's been unrest, I haven't been able to sleep."

Carden alleges that her neighbors have been cooking meat and fish in their garden on purpose and that it had caused her "undue offence," the BBC reported.

"It's deliberate, that's what I told the courts, it's deliberate," she told Nine News. "Exactly what I've wanted from the word go is to live my life in peace."

Carden eventually resorted to taking the case to the Supreme Court of the state of Western Australia, claiming that her neighbors' actions breached residential laws.

Carden also wanted to try and force neighbors to reduce their patio lighting, and reduce the amount of noise that their pets made.

However, her case was thrown out by a tribunal and a Supreme Court judge who ended up siding with the neighbors, saying her claims were unreasonable and lacking evidence, the BBC reported. Carden subsequently filed an appeal, but this has also been dismissed.

One of Carden's neighborswho did not want to be identifiedtold Nine News that he wanted to keep the peace, and had removed a barbecue from his back yard and told his children to stop playing basketball.

"The Tribunal does not accept that [the parents], by allowing their children to play in the backyard... use the patio for small scooters or toys, constitutes reasonably a nuisance," a State Administrative Tribunal of Western Australia found. "What they are doing is living in their backyard and their home as a family."

Despite these setbacks, Carden says she will keep fighting and is planning to return to court soon.

Another neighborwho also wished to remain anonymoussaid in a statement provided to Nine News: "Ms Carden's demands were proven to be not reasonable and indeed were to the detriment of the other owners' ability to enjoy their lots in a reasonable and acceptable manner."

I understand unpleasant smells, but it can be kind of hard to make the smell stay away from her. They also shouldnt have to not have a cookout or BBQ in their own yard. I mean, Ive smelled people cooking things that didnt smell great, but I didnt tell them to stop or try to sue them. And then the other complaints, as well...

I ordered a vegan dish at a restaurant that also serves animal products, and advertises their vegan options heavily

Emphasized all items vegan

Was served a normal chicken curry dish. Meat, dairy, and all. It made me sick. Didn't notice immediately as I was using naan to eat it. Had that first bite and it seemed way dry and off for veg chicken. Poked at another piece with a fork and definitely chicken.

I guess my bad for eating somewhere that also serves meat. Really not a cool mistake. I'm lactose intolerant and that sauce fucked me up

I hate hate HATE the smell/smoke of barbecue. I can't even leave the window to the backyard because then the smell comes in and the entire apartment ends up smelling like it. Makes my hair stand on end. For me it has nothing to do with meat. Vegan or not you're setting things on fire outside other people's homes and windows. (and probably ruining air conditioners in the process) So everyone has to suffer through an odor cocktail of smoke, burnt charcoal and burnt bbq sauce. (Do people even manually extinguish the fire after they're finished cooking?) I've literally stopped walking past a certain block in my neighborhood because I walk past people's barbecue smoke and my clothes end up smelling like it when I get home. Anyway I feel sorry that the court ruled against her.

Well, I guess that sucks for you and her. But the courts decided that people have the right to live their lives. Especially on their own property. And shes really the only one complaining about the smell. As the other neighbors are fine with it. Most probably like it. It usually smells good to many people, tbh...

Absolutely not your fault. My kid has food allergies and if he was served something he is allergic to after I explicitly stated his allergies to the server, I would be livid.

There are "higher risk" establishments we avoid as a family, but as a whole, restaurants should be trained and prepped and knowledgeable in serving customers with allergies and other dietary needs. If they can't ensure the quality and safety of their food, then frankly they don't deserve to hold a license to serve food.

Not all of them.

I know vegans who never throw it in your face or demean you for eating meat, and vegans who politely advance their agenda in a non-confrontational way.

But like any societal or cultural grouping there's always going to be a smattering of assholes. Add in that vegan assholes can be very preachy and judgmental and the asshole factor goes through the roof. Vegan assholes are assholes on such a phenomenally asshole level that it can skew your perception of vegans as a whole, so much that your patience around vegans is stretched so thin that it doesn't take much for even non-asshole vegans to get on your nerves

FFS. What a miserable neighbour to have.

I'd have had some sympathy if the kids' noise gave her migraines or something... excessive high-pitched screaming has had that effect on me before, & the kids in my apartment block have a frustrating habit of bringing their stuff down to play *right outside my bedroom window* when they don't even live on my side of the block & they do know I often need to sleep during the day. But in her case, not only are the kids playing in their own back yard, but she doesn't work nights & she's reportedly not disabled or anything, so she just seems to be whinging for the sake of it.

The BBQ thing, I can see it if they have them a lot, but really, nobody barbecues stuff that often. To complain about once a week or less is going overboard. So she's vegan. So what? Why should her neighbours be expected to adjust their dietary habits for her benefit? If she isn't going to go into anaphylactic shock or hemiplegic migraine from just smelling their stuff, there's no justification for her level of complaint. It would be different if they'd been smoking & the fumes drifted into her yard - that could actively damage her health.

It seems to me that this person doesn't like being anybody's "neighbour". As others here have said, she needs to find someplace where she can live off by herself without anyone else about. Though she seems the type who'd find something to complain about even then.

The bbq protest was cancelled over logistical concerns (since thousands were planning to attend) and the fact it constituted harassment/trespassing.
