NC's state-level gerrymandering was struck down in state court today as against the state constitution. GOP has declined to appeal (NC Supreme Court is 6-1 Dem so lol.) The court ordered the legislature to redraw the maps (with restrictions) within the next two weeks or they'll appoint a special master to do it.

North Carolina was one of five (I think) states where Democrats won the popular vote across the state in 2018 but got a minority of seats (55-65).

It's also the 11th time the GOP has lost in court on gerrymandering since 2013 in NC.

So, are the opposition parties in Parliament going to keep Boris as PM to avoid an election but govern from Parliament by passing bills by majority vote?

I guess the nuclear option would be for Boris to advise the Queen to refuse royal assent to such bills until Parliament agrees to hold an election.

Less snarky: By winning state-wide elections. From 2004-2016 the NC judicial races were non-partisan. In the lead-up to 2016 the NC GOP attempted a number of power grabs that ended in miserable failure.

Going into 2016, the GOP held a 4-3 majority on the court. GOP Legislature tried to give a GOP judge up for reelection the option to go for a retention election rather than against other candidates. (Voters would have the option to vote for/against the judge. If against won, the governor (then Republican) would appoint a replacement. It was challenged in court and found unconstitutional (by a lower court, the Supreme Court split 3-3 with the judge in question recused so the lower ruling stood.) The Legislature also passed a law to have the party affiliation on the ballot though it was technically still non-partisan.

The Democratic candidate won with 54% of the vote.

When 2018 came around the legislature made judicial elections fully partisan and then also cancelled primary elections so any amount of candidates of the same party could run. This backfired when a guy changed his affiliation to Republican the day he filed to run. He got 16.4% of the vote. The GOP incumbent got 34%, Democratic candidate won with 49.6%. Democrats swept judicial elections in 2018 (3 Court of Appeals seats were up and 2 were GOP->Dem flips.)

In 2019, the GOP Chief Justice retired. Governor appointed one of the associates to chief justice and then appointed a Court of Appeals judge to the vacancy, this seat will be up for election in 2020 along with the sole remaining GOP seat and the Chief Justice whose term when first elected ends.

Also, the Fixed Terms Parliaments Act was not well thought out. If you are going to have fixed terms you can't have a executive based on the confidence of the parliament at the same time. You either decouple the executive from the legislature and have separate elections, or you mandate new elections when the executive loses the confidence of the legislature, which necessarily requires not having fixed terms. Here, we've had this strange twilight world when they had an election in 2017 even though the government already had the confidence of Parliament, but today, the government obviously does not have the confidence of Parliament yet Parliament does not want a new election or to get rid of the government.

I would say the Parliament Acts 1911 and 1949 were also ill-advised. They dramatically reduced the UK's system of checks and balances resulting in a bare majority of the Commons wielding dictatorial power. Moreover, the King's acquiescence to such a radical request by the PM to threaten to stack the House of Lords with cronies destroyed another check and balance. Thus, in a single shot, both the House of Lords and the monarch were removed from the picture and the House of Commons (and the PM) was left with no checks on its power.

I feel like the King made a terrible mistake in 1911 - he should have listened politely to the PM's advice and announced that he would not follow it because it was blatantly unconstitutional. Then fired the PM and called new elections.

The Tories are screwed, as Labour+Lib Dem+SNP is now an effective majority. There might not need to be an election, and if there is Bojo will really struggle for a majority. Bojo is essentially out of government and no deal brexit is thankfully dead. It was an insane idea to begin with, holding yourself to ransom as a negotiating tactic.

I wonder if this isn't some pretext for advising the Queen to refuse royal assent (the PM can say, this bill doesn't reflect the will of Parliament, it was voted through because of the absence of tellers to count the votes).
