probably the most unprofessional ever in my 10 year retail career.

woman comes up with some items, and one wasnt on sale but the sale tag was still on the shelf. an item hidden in the corner, hard to see, but still had its old tag up somebody forgot to take down.

so i go over to investigate, see customer is right, go find the manager to get a price override.

Now this manager is an idiot meathead and the only person at my liquor store job I can say I dislike to any real degree. Any other manager would have handled this much better but the guy affectionately known as "captain chaos" just had to meathead it up.

So I inform him of the tag still being up, and he goes "MOTHERFUCKER" outside of peoples earshot. Now I know he isnt mad at me, but he rubs you the wrong way.

So he goes to the register, and first he explains the old tag was up and it isnt on sale. I can see this, just state what the problem is to see if they understand and decide to get something else. But, if they insist, which this customer did, about the sale price I'd say since its our mistake 100%, you need to give them the sale price.

so, after she says she wants it at the sale price he decides to do something highly unprofessional. He then decides to trash the product saying its terrible, too sweet, and you wouldnt want it anyways. Just going on and on about how terrible it is(doubt he's ever had the product). Rather than give in and give her the five dollars i'd say she is entitled to, he just keeps trashing the product.

I guess it worked because the customer didnt buy it and instead bought something else. the entire time this was going on i really wanted to sink into the ground.

But hey, only 41 more months of captain chaos, then he can retire and "get trashed every fuckin day"

oh man....what an asshole.

thankfully I only have to work with this guy every now and again as he's one of three managers at a store i dont work at all the time, and since he's the head manager he kinda chooses when he wants to work which isnt as often as the other two thankfully

I was even told in training you arent allowed to say something a customer is buying sucks. You can recommend other things you think they might enjoy more, and you can make suggestions but you cant flat out say something a customer is buying sucks.

But even if that wasnt some sort of policy somewhere in the annals of my company, its just unprofessional and downright rude to say something somebody is buying sucks. Though i doubt he ever had the product in question, he just didnt want to give in and adjust the price for our mistake so he had to get the customer to not buy it one way or the other.

Most retail places would just give the customer the sale price, and then immediately change the tag or fix the price in the system. Some stores will even give the customer an item for free if it rings up wrong.

It's not required at all, but certainly is a better option than losing a sale and/or a potential future customer.

I suspect she took an old tag and planted it there for future use.

ive always seen it that way.

regardless of that, though, the unprofessional part wasnt not giving the sale price, but trashing the product the customer was buying in hopes they give up and get something else. Ive never seen a manager do this before and nobody in the company i work or that ive worked with would. I can see going "Hey, that product is a little too sweet perhaps i could reccomend X" or something, but the manager flat out, almost yelling said "this stuff is garbage anyways, way too sweet, you dont want it" and then kept going at it.

Its wholly the managers decision. No company in their right mind would unilaterally accept an incorrect price without context. Accidents, and petulant workers exist.

In California it's not up to the manager at all. It doesn't matter if the sale is over and the tag was forgotten by a lazy employee. If it's there then it must be sold at that price.

No. You dont. Should you as an act of good faith and future interest in their patronage? Yes. But need? No. Absolutely not.

I think some states have a law regarding that?

Yeah, this is actually pretty tame by retail standards. It's still a halfway decent retail story, though.

I have yet to see it. For the reasons I've already posted. Sneaky customers, disgruntled workers, just plain accidents.

Considering there's been several times BestBuy.Com has had an incorrect price, and they've refused to honor it, it's never mentioned anything about being required to in certain states.

People think it's a law, but I have yet to see any area stupid enough to do it.

Weird... Ive seen plenty of places that do it. Whether they do it because they think its the law or do it because theyre nice, Idk. But places do honor the marked down price sometimes...

I just looked into it, and that's not what the law is about. It's about preventing companies from advertising a certain price and then trying to sell it for more as a bait and switch type thing. It even gives an exemption to prices that had specific date ranges on them. I.E.: Sales that have ended, but the price is still visible.

Then you read it incorrectly. I believe you were likely confused by the use of the word "notwithstanding" in the second part of B&P code 12024.2. Notwithstanding means despite or in spite of. So it says "Charge an amount greater than the lowest price posted on the commodity itself or on a shelf tag that corresponds to the commodity, despite any limitation of the time period for which the posted price is in effect.

So even if the sale is over they still have to honor the price if they didn't remove the sale tags.

I figure that's where your confusion came from because despite knowing that it is indeed a law here in california, that word made me pause for a moment. I had to look it up myself. The word just feels a little counterintuitive to its actual meaning.

Pay special attention to sections e and f. F lists the only exceptions.
