It basically is. But Punk is being particularly obnoxious and his lawyer sorta sucks, so the jury may not like that. But I think the line of questioning has sufficiently buried Amann since he has provided literally no actual damages. It's boggling how he thought he had a case and I totally see why they didn't settle. There's absolutely nothing there from Amann's side.

You can't put any sort of price on Amann's damages. How do you put a price on his literal only damages being Twitter Harassment. Makes no sense. Is Punk going to owe him and his family a turkey? If he had any damages related to his job or friends or colleagues, it's one thing, but this is nothing.

Way I see it there are two things you have to prove for Punk to have any chance to lose the case

- Punk was actually being defamatory on the podcast and not just telling the truth
- Punk's actions caused any damages

First point is probably a bit shaky, though honestly from what I read there it looks like Punk probably was more or less telling the truth. The second point seems kinda impossible to lose given what has already been stated by Amann

Probably to cast doubt on Punk's recollection of what happened? I dunno. Thing is that's like still shaky because even if you sell on Punk's memory of the night being scrambled then you'd have to prove that Punk didn't sufficiently consider whether the statement was true or not for it to be defamation even if his memory is proven to not be credible enough for that to be evidence that it was true as I understand it (not remotely a lawyer so maybe I'm wrong-- I'd ping Drakeryn right now if he had any remote interest in wrestling but what can you do). Also I think the meat of Punk's grief with the guy wasn't explicitly from the concussed point but earlier nights so I don't know.

But I dunno I guess that's the strategy they want.

Theres another big indie scandal

Theres a guy whose ring name is Earl Cooter, who has a promoters license. Because some states (New York in this instance) still have athletic commissions that require such licenses, he facilitates indies like EVOLVE, SHINE, and ICW (not the Scottish one).

Apparently he was in line for a WWE tryout and was so sure of getting signed that he didnt renew his promoters license. (He didnt get signed)

Problem is, he never tells anyone, and now ICW and possibly SHINE have to cancel shows because of the short notice from the commission that no valid license was ever presented for these events.

What a carnie!
