28 y/o Christian Nutjob, Michael Ray Webber caused movie theatre havoc in California after he stood up during the middle of the opening of Avengers: Infinity War and raised his arms in the air and screamed GOD...at that point people started SCREAMING and YELLING as they ran over each other and one woman jumped over the RAILINGS to get away..

The whack preacher sparked fears of a shooting at Redlands Harkins Theatre in San Bernadino when he suddenly got out of his seat to scream that word..

He started preaching about God and triggered mass panic thinking he had a gun

A woman LEAPT over a balcony to escape and fel 20 FEET to the ground where she was then TRAMPLED on by others trying ot get out..

Dozens of people started phoning police, including one who made a false claim that someone made "30-40 shots"

Michael says he was "confused" by the reaction and said he intentionally held his hands up to show he was not armed and says he regularly preaches about God during film screenings so that more people follow the path of God since young people were "no longer believing"..

He was arrested at the scene as police checked his home to determine if he was a threat. He was charged for "offensive language likely to cause a violent reaction"

2 people were seriously injured in the mass escape...

Do you think this freak should get jail time for this??

Where it happened -

Community service should suffice. Maybe a fine to the theater for damages caused by the escaping theatergoers.

There's no need to put a guy in jail/prison for a "crime" like this, which really just boils down to cause a panic.

I'm not sure that's a foreseeable consequence?

The thing about shouting fire is that you know what you're doing. You know people are going to panic in trying to escape the non-existent fire. While this is a really bizarre way to try to convert people, I'm not sure if that sort of reaction can be reasonably anticipated. Usually when someone shouts in a theater, it's just rude, but doesn't cause any sort of panic.

Make sure you qualify that statement. Most terrorists are not Christians. In America though, perhaps yeah. Good security I guess, so we mostly just deal with our own psychopaths.

Other than that, for sure, I'd have probably been startled as well, but I probably would have stopped when I noticed the guy seemed more bewildered than prepping for detonation. But maybe not lol.

Can't yell fire in a theater. When I'm in a theater and some nut nob stands up and waves his arms and starts yelling I don't care if he is yelling "fire" "allah" or "god". I'm perceiving him as a threat. It's not protected speech. What he did was a crime, just like calling in a bomb threat is not protected speech.

He bears responsibility for his actions, and I'm more troubled by him saying he frequently does this. Fuck him, people aren't paying money to have their movie ruined by his inane ranting.

It's questionable how many people heard him. Regardless of what he yelled someone standing up in a dark theater and yelling ANYTHING is very abnormal behavior. We live in a world that is going insane, and we can't just deem people who do bizarre things as harmless anymore. It's not like a theater shooting has never occurred before.

I believe the law states you are responsible for any injuries that occur if you incite a crowd to panic due to your actions (as long as they are not warranted).

In this case, he may not have expected shouting "God" would cause a panic, but that does not excuse him from the fact that it did.

Any injuries therefore, are his fault, both legally and financially.

While I think Jail time is stupid in such a case (and most cases, I hate jails), I do think something needs to be done so that he compensates the people he hurt, and the lives he disrupted. Community service, fines etc. If he is a "man of god" then he can now show that by supporting the community, helping the poor and helping pay for any medical bills that arose due to his actions.

He shouldn't even need the government to tell him that.

The difference between shouting "fire" and "god" is an overt attempt to cause alarm. While I'm not necessarily saying he shouldn't be punished, it's not even close to being the same thing. His action was weird and disruptive, but the word choice doesn't seem intended to alarm or cause panic. And bear in mind that even if he isn't charged criminally, he can sued for the injuries resulting from his action.

And, honestly, people charging out is a dramatic overreaction. Shouting in theaters is obnoxious but not that uncommon. The only thing I can imagine is "god" sounded like "gun"

If you'd bothered reading your source:
In this opinion, Holmes said that expressions which in the circumstances were intended to result in a crime, and posed a "clear and present danger" of succeeding, could be punished.

Which, again, requires intent. When somebody shouts "fire" in a crowded theater, they're intending to cause a panic. When somebody shouts "god" or any other number of other things, there's no explicit intent to cause panic unless we lived in a nation which believed the Rapture was right around the corner and god was forcibly spiriting people up.

BlackScythe0 posted...
Where outside of the US would this be considered legal?

Pretty much everywhere? You'd still be kicked out of the theater, but most places wouldn't necessarily arrest you for shouting "god." It's weird and it's disruptive, but it's more of a thing that's handled by the establishment than the cops.
