Hunter "mistook her for a deer." Shot her with a pistol from afar. It was dusk, low light conditions, when shooting deer is supposed to be prohibited... for this exact reason... Apparently the dog she was walking wouldn't leave her body, just laid down by her side and refused to leave her, had to be forcibly contained by police.

I used 30-06 and 308 for both deer and black bear. I had a rifled shotgun that could accurately hit anything at 150 meters but never actually shot anything with it.

I couldn't imagine using a small caliber. 226 unless a perfect shot is just going to fuck the animal up for no reason.

I heard of a similar case back in the early 2000s. An individual thought he was going to get a deer before he ever stepped off the porch of his cabin. He ended up shooting and killing a mail carrier. The victim's family sued and ended up getting the guy's cabin.

It's bullshit. Irresponsible want to boast about hitting a one in a million shot so badly that they're willing to risk the possibility that what they're shooting isn't actually a deer. A four legged silhouette off in the distance might be a deer, a white newspaper might be a deer's tail, better grab my gun so I can brag to my friends how I killed something I saw out of the corner of my eye at low light.

I had the inverse happened to me when I hit a deer last November. I saw people running across the road, then I collided with a large buck. When you're dealing with low lighting and split second glances, your mind fills in the blanks as to what should be there.

Not sure it's been mentioned, but the article says he isn't being prosecuted either.

Oh well, everyone makes mistakes. Live and let live I suppose.

Hunting defenseless animals for fun is a "white man" hobby, of course he wouldn't have that excuse.

He should be charged with 2nd degree murder.

He was on private property which he didn't have permission to hunt. He did not properly identify his target and what was behind his target. He used the wrong gun for the range he was at because a pistol is not accurate at 200 yards or even 100 yards. He most likely didn't have a doe tag or hunters license and his lack of hunter safety knowledge tells me he never took a mandatory hunter/trapper education course prior to this.

Edit: He was also hunting after dusk which is also illegal
edit 2: forgot 1 more law he most likely broke. ammunition capacity in NY is 6 rounds. His pistol was most likely 10 round capacity

If anyone had actually read the article, you'd have read the line about it being a 'single shot' pistol. This wasn't a normal, everyday pistol. This is some kind of tricked out bullshit that he was using for hunting.
