Pretty shady here.

GameStop does stuff like this. The big publishers want to eliminate the used market.

My stars, is there ANYONE left for an old console gamer like me to root for????

And get your STEAMY CRAPS outta here, PC fans.

PC > Consoles

And developers are in the right for wanting to either remove or make money off the used game market.

No, see, joyrock. There is nothing illegal about removing the OnLive. What could be illegal is then selling the product without informing the consumer.

It is, in fact tampering with the product, as well as false advertising.

Tampering with the product? Are there special rules when Gamestop buys them? Cause I thought it just became theirs same as it becomes yours when you buy it. They could even destroy all their copies or withold them or give them out for free if they really wanted to can't they?

Nope, they own the games they bought, so they can legally remove it. Like if you buy a game, you can legally throw out the OnLive coupon.

Whether they state they removed it or not is the issue.

Product tampering the unauthorized altering of a consumer product without the knowledge of the product's owner or eventual user.

In other words, once you inform the eventual purchaser, it is no longer product tampering.

Boned? Probably not. Square Enix sues, Gamestop counter-sues, they settle out of court, nothing happens. It can almost guarantee it won't be a PC exclusive item that finally sinks Gamestop, or even comes close to hurting it.

I guess technically they own it, although I would assume that when stores obtain products that they sell, they have to sign agreements that they won't tamper with the product before they sell it to the consumer.

I don't know about anyone else, but I just like the feeling of opening a new game. I'm the first and only owner to have opened this, and it's as it was supposed to come. That said, 90% of "new" games that I've bought from Gamestop have all been opened. Might as well buy a used copy, which I hate doing. Basically I just try to avoid Gamestop outside of pre-orders.

Actually it's bad for the consumer, too; trouble is, most consumers are short-sighted like you and not seeing the damage you're doing to the industry or thinking of the bad that will come of it.

If publishers do adopt a more digital-friendly format where every game is offered for download, I'd be cool with that so long as they offer price reductions for those gamers who wait to purchase. As it stands right now, I can often get a $60 game for like $20 a year after release, and it's usually still in new condition on Amazon. If publishers can match that via digital distribution, I'd support it despite missing physical copies.

Even if they don't, it's well publicized that it comes with Onlive, making this illegal.

That is a responsibility of the publisher, and I agree that more should. But that's after a year; when people can go buy a game slightly cheaper that has been out for only a few weeks, and the developer gets none of the profits, there is a significant problem, regardless of game content.

That's not how the law works. If GameStop personally didn't advertise it, and it's not on the box, then it's technically not illegal. Is it fair? Not necessarily, no. But that's how it works.

Advertised by who? If it's not a GameStop ad, why would they be legally obligated to follow the advertisement? Also, a lot of the time advertised bonuses have fine print that say they aren't necessarily available everywhere.

Gamestop had no ethical right to do what they did. If they had a problem with what was being packaged with the game by the developers of the game they should have sent it all back then refunded their customers who preordered it.

See, I don't really have a big problem with this. Is it fair? Not really, but they're within their legal rights to do so. It'd be like the Yankees ordering a bunch of foam fingers, and then with said foam fingers, the manufacturer had made a deal and is attaching a sheet of Red Sox stickers to every finger. Obviously, they're not gonna leave the stickers on there. You don't promote competition.

I'm not saying they're RIGHT, necessarily... I'm just saying that I, personally, couldn't care less. They still have plenty of reasons for me to shop there. I'm not gonna be dissuaded by something I wasn't even gonna buy.

I don't buy from Gamestop often, it bothers me to not have the shrink wrap on the game when I buy it. Almost bought Kingdom Hearts II from them but then watched the employee pull a disc, put it in the case, etc. Told them no thanks, walked to Best Buy to buy it instead!

Do they always open PC games? With activation codes that seems like an even bigger issue than with console games.

I have no problem with this.

They probably have some kind of working agreement to crosspromote with steam while onlive did no such thing. It was basically a hostile economic act by onlive and gs responded in kind.

In that case, if they really felt that way, then DON'T SELL THE GAME, like I said earlier.

You know that wasnt going to be possible considering its the kind of thing people preordered and they would suffer a larger credibility loss from failing to deliver on preorders than doing what they did.

Why do they open games anyway? I've never had this problem at any gamestop I've frequented (only 3 in my life granted). If I buy a new game, unless it's the display copy, it's shrink wrapped. What's the logic behind opening it? So employees can just steal codes and get all the Club Nintendo perks?
