Kid took a swig and spit it out. Didnt even swallow. I fail to see how a little vinegar would cause a hospitalization. Maybe there just isnt enough information. I cant help but think the bully is just manipulating the situation with his sickness so he gets babied and it turns on the other kid.

The law might be on the bully's side unfortunately. I've heard of similar stories involving coworkers and unless you can reasonably argue that the beverage was for your own consumption then you can get in trouble for setting traps like this, even if the other person had to steal to get caught.

This is another thing, what is the standard for reporting hospitalization? Is it the bullys parent claiming I had to take my son to the hospital because you poisoned him even though there was no poison?

im just having trouble believing lemon and vinegar crosses a legal threshold of poisoning attempt. According to a quick google search, vinegar can be outright safe to drink in moderate amounts in fact.

That, or it could just be a matter of not knowing what was in it. Taking a swig of something gross and not knowing what you just drank could trigger a very adverse reaction, sort of like a reverse placebo effect
