House GOP meeting is going on 3 hours without clear path yet for McHenry resolution
From CNN's Melanie Zanona and Manu Raju
The House GOP Conference meeting is now going on three hours and has grown increasingly heated, with no clear path forward on a resolution to temporarily empower interim Speaker Patrick McHenry.
Lawmakers in the room are debating the resolution which has received fierce pushback from conservatives and others in the conference, despite the fact that Speaker designee Jim Jordan has gotten behind the idea. Others have argued that such a move is the only viable option to re-open the House given that no speaker candidate seems to be able to get 217 votes.
But some lawmakers say the prospects for the resolution look grim right now.
Florida Rep. Vern Buchanan, who voted against Jordan's speakership bid in the second round of voting Wednesday, said the measure appears dead.
And former Speaker Kevin McCarthy, whose ouster earlier this month precipitated the current crisis, said he doesnt think the resolution should come to the floor unless it has the support of a majority of the conference's support which Republicans do not believe it has at this point.
A GOP leadership aide tells CNN that no decisions have been made about if and how theyre going to bring this forward.

The fact that the rule even exists makes the GOP's failure to select a Speaker even funnier.

Like if Scalise or Jordan did something you didn't like you could easily just motion to vacate their seat too. The simple fact that the rule hovers over them ensures that the Speaker must be cooperative. There's no good non-political reason they can't pick someone under these conditions.

McHenry is the only option who'd be exempt to this since he wouldn't officially be the Speaker, just an interim one. Probably why the idea of empowering him is being resisted so much.

Even the Republicans don't know. Some have been saying that a resolution is unnecessary to begin with because McHenry already has the powers that'd be granted to him by one, and is just choosing not to use them. It's all procedural gray area only being exposed by the unprecedented incompetence of the modern GOP.

Relevant section 8.b.3.A --

In the case of a vacancy in the Office of Speaker, the next Member on the list described in subdividsion (B) shall act as Speaker pro tempore until the elction of a Speaker or a Speaker pro tempore. Pending such election the Member acting as Speaker pro tempore may exercise such authorities of the Office of Speaker as may be necessary and appropriate to that end.

That's the applicable language about whether McHenry already has the power. You could argue it either way but if McHenry chose to exercise the full powers of the job I think it's unlikely that he could be stopped by anything other than a permanent speaker being elected.

To be fair, after Scalise won the conference vote Jordan did in fact endorse him. It was other Republicans who shut him down. (a mixture of moderates who felt Scalise was too far-right and MAGA who felt he wasn't far-right enough)

It definitely can not be read either way, but it has a dependent clause like the 2nd Amendment, so point to Republicans for their continued lack of English comprehension. I'm not one to advocate for corruption, but now would be a good time for Biden to privately intimate to some folks that any Republican that votes for Jeffries for speaker and then proceeds to stay out of his way gets to choose the ambassadorship to the small Oceanic, Caribbean, or European country of their choice in 2025 should they be out of a job thereabouts.
