Sue them for what? The package is most probably insured and the sender will get their money back and ship a new container. You need to show damages of some sort to be successful in a lawsuit. Simply going "but it was medication!" isn't a valid form of damages. Even if it was for a life threatening condition, you have to show that you could not have been able to get the replacement medication in time.

People really need to hop off the litigious stripper pole.

I had a couple bottles of tecfidera swiped off my porch back before I switched meds. All you're going to get popping those is the feeling of being hot and itchy (flushing) and a potentially fucked up immune system.

And yeah, dipshit porch pirates dont seem to realize pretty much any medication that is getting delivered isnt going to be a narcotic.

Typically you authorize them to release it without signature, which frees them of exactly that liability

When I called they said they offer the option to sign but I did not get that offer.

And I also can't get another order because it's $180 after my insurance and they use a manufacturers coupon that can only be used once a month to bring the cost to $0. So I either can pay $65 for the generic with insurance or $180 for the name brand I usually get free. I'm not doing either so now I won't have this medication for a month

Yeah this is literally an oral antibiotic for my skin. You can't get high off it at all. I almost wish it was my linzess so they'd have mad diarrhea when they tried to take it lol

They can't get high off of oral antibiotic for skin, but I guarantee you they are desperate and stupid enough to try. LOL. If you see any young people with very bleached up nose hair around your neighborhood (if they are stealing it from your porch then 9 times out of 10 it's someone who lives on your block or a block very, very close by) that's definitely someone to suspect. LOL.

90% chance it's someone in a house somewhere in the neighborhood (thieves / junkies close by are typically the ones who steal packages from porches) and 90% chance it's a younger person (those are typically the ones that most of the time don't have access to real drugs due to monetary or availability issues, so they have to rely on getting high in alternative ways). Only a 10% chance it's someone from a few miles away driving around to other neighborhoods looking at porches while driving by and 10% chance it's an older person (if it is then it's an older person who is under some type of semi-lockdown at home and can't get out beyond their neighborhood to purchase real drugs so they are roaming around to close by houses looking to see what they can find).

I don't see why the insurance/coupon would make it any more convoluted. The cost you have to incur to get a replacement is $180, so that's the cost that should be incurred by their insurance to cover the consequence of them failing to ensure the package was delivered securely. That you paid $0 for the initial product doesn't change the replacement value.

Now, the fact that you refused a signature might mean you don't win that fight. They did offer a more secure delivery option, but you turned it down, so that probably absolves them of any shortcomings there.

I did not get offered a signature for this one. Sometimes I can sign for it on the website for the delivery so they can leave it but I didn't do that this time and they did not get a delivery signature.

What actually annoys me is that they did their job right but my roommate saw my package and left and didn't bring it in. Then it got taken. So I don't even think the pharmacy should be responsible.

But they are. They're legally obligated to deliver the product to you. If the package gets stolen before then, they have to send you another. They're the one who should be dealing with the theft, not you. Signatures also don't protect them. All it does is make it easier for them to deal with potential theft and reduce the risk of it.

its not as good as a real security camera recording but they will think you have one and it might deter them. It also helps if you can get your hands on some security camera companys sticker that they put on doors.

its not as good as having the actual service but it wont cost an arm and a leg.

The law regarding delivery is pretty much the same in the US, UK, EU, Canada, NZ, and Australia. I haven't checked other countries.

Legally, a package is considered delivered if the customer, or someone on behalf of the customer, physically receives in person the package. Unless the customer personally contracted the carrier, they only have to deal with the seller. You are entitled to ask for a full refund, including shipping costs, or ask for the item to be redelivered if you don't receive it within the promised delivery date or within reasonable time if a date wasn't specified (the time may vary depending on your country, but usually it's 30 days).

The seller is contractually obligated to the customer. If the carrier the seller contracted is faulty, it's up to the seller to deal with them, not the customer. If for example the delivery firm steals the package instead of delivering it, they are still not liable. The seller must refund the customer even in that case.

Pro Tip: If the seller makes your life difficult or doesn't seem to want to follow the law, just ask your credit card company to do a chargeback. This obviously only works if you paid with a credit card, which is what you should always use online due to the extra protection. By the way, chargebacks are very bad for sellers because they have to pay extra fees. And when a credit card company sends too many chargebacks to any given company, they may ban them, making them unable to accept credit cards. Not being able to accept credit cards can be a death sentence to online retailers, as it's pretty much what the vast majority of customers use.

Credit card companies have zero incentive to refuse chargebacks, they're being paid either way and they know that refusal means they lose a client. Yes, this basically means that the buyer has a lot of power that can be prone to abuse. But remember that without it, the retailers are the ones with that power. It's unfair for big companies with a lot of money to be able to so easily abuse customers. Let's turn the tables around and ask for a chargeback. If you abuse it, it's up to the retailer to prove it and do the steps necessary to sue you. Now you're the one with the advantage. It's basically a UNO Reverse card.

It was just the "American" answer. Post 12 is more in-line with what I actually think.

While it is obviously never guaranteed, most companies have a system in-place for lost deliveries, you do need to inform them to get it going.
