US companies haven't exactly given a damn about what's legal for some time now, and no one with any power has been going after them except a few "radical leftists." That is how far to the right and into the land of insanity our country has become.

it is legal, yes

overtime is only working more than your required hours. so if your standard work time is 9-5 m-f, so your normal 9 hour work period. anything over that is overtime.

but if they change your work period to 12 hour days, then anything over that is considered overtime.

Federal law states that anything over 40 hours in a work week is overtime, for non exempt employees. Some states, like the one that I live in, expand on that by including anything over 8 hours in a day.

So even in states that don't have a daily limit you could only work 3 days a week on 12 hour shifts before the company would have to pay overtime. 4 days of that would exceed the federal limits and require overtime pay.

I agree that the Nabisco workers are right in their strike, but this statement makes zero sense and counters the point you're making.

12 hour shifts with 4 days on and 4 days off (8 day work cycle) is more working time than a standard 40 hour work week (7 day work cycle).

48 hours / 8 days = 6 hours per day on average

40 hours/ 7 days = 5.714 hours per day on average

Don't try to bring breaks into this equation. You're still at work during a break. It still eats up part of your day and doesn't form what nearly anyone would call your free time.

There are too many variables to make a blanket statement IMO, but thats the closest to being true. A lot of it will be determined by state/federal law, along with union stipulations if you have one. For instance, I believe if youre working something thats considered seasonal then your hours over 40 dont qualify as OT. Thats why places like Cedar Point bring labor in from overseas.

Im now a Federal employee which also somehow requires that Im in a union. So I get OT on weekends and anything more than 8 hours in a day, excluding my unpaid lunch. But my last job it was just OT in anything over 40 in a week. By comparison I could technically work something like 38 hours here and still get OT pay if one of those days in that week had me work over 8 hours.
