9 y/o Lydia Booth from Mississippi was BANNED from wearing this face mask to school after she was forced to remove it and now her parents are filing a lawsuit violating her first amendment rights!!

It happened at Simpson Central School when Principal Antoinette Woodall demanded the 3rd grader to take off the covering because it violated school's policy

Now they filed a lawsuit in US District Court after an assistant teacher gave her a plain face mask substitute as Matthew and Jennifer Booth are seeking a JURY trial and demanding MILLIONS in damages saying it greatly upset their little girl

They said there was nothing in the handbook about wearing this type of mask and claim they updated the school policy 2 days after this to ban any political, sexual or religious face coverings

They also said students were allowed to wear sports team logos on it or "Black Lives Matter" which they say is political and should be banned

Now with the help of the Alliance Defending Freedom Association they will sue on Lydia's consititutional rights as lawyer Michael Ross says public schools have a duty to respect free expression of students that the First Amendment Rights guarantees them

for better or worse, this nation was founded on the belief that people should be free to believe stupid things if that's what they want to do. this family definitely shouldn't get millions or probably even any money for this, but it was probably not within the purview of the school's authority to have told the girl she can't wear it.

But it is. Schools have enforced dress codes and specific policies for ages beyond count.

She can't wear it at school... this isn't the same as a cop or someone demanding she take it off in a space open to the public.

Its no different than a business saying no shoes no shirt no service (or no mask no service for that matter).

It's well within the school's purview. They have dress codes set out, and many of them don't allow graphics or images. They don't allow gang symbols, or political symbols. She's free to practice her religion. That doesn't require the mask to push it onto other people.

I don't think it's comparable. A simple religious symbol is just that - a recognizable icon.

The problem with masks is that they've become a fashion accessory for self-expression and there are myriad messages and patterns you can get on your mask. It's quite possible that someone *could* wear a religious mask with a more offensive message on it. To avoid that sort of issue, it's easier for a school to just outright ban religious, political, etc. messaging on masks to apply a fair and objective criteria that *all* students can observe. It gets rid of any grey area.

And yeah masks are fashion accessories, but I've also seen tons of flashy crosses and such.

Again I'd side with the school if the message on it was negative (like that post from a few weeks back where the kid had the anti-gay shirt, fuck that). But this is a positive message that doesn't push onto other students.

I would assume it was a disposable unused mask man. No idea why you assumed otherwise with the given information here except it allows you to continue disagreeing.

I don't think the teacher just took a mask shed taken from some other random and said "put this on."

Every single store here which requires masks has a person at the front entrance with a box of disposable masks. Seriously doubt the school wasn't doing the same.

No one in their right mind would use someone else's mask, that defeats the entire purpose. Just common sense that it was a clean disposable one.

If they actually gave her a used mask, that's worth suing over. As it is, this kind of case pops up regularly enough that courts are catching up and just throwing it out.

That's why the policy says they encourage just wearing plain black masks, masks with school colors, or masks with the school mascot on it.

The parents set their sights too high with this one. Nobody is going to award you millions of dollars because someone denied you the right to identify your religion for all to see.

That said, I would think this was fair if they were simply suing for the right to wear the mask. This isn't a club which has a dress code prohibited religious imagery. The school system is an institution which you are mandated to attend. Yes, private schools do exist -- but only if you can afford them. If an individual wishes to wear a cross, a yarmulke, a hijab, or Buddhist prayer beads at all times, they should have a right to do so. If it means they're not allowed in certain places, they can adjust themselves accordingly. But they can't opt to stay out of the school. The state beckons.

I know there are people who salivate at the thought of eliminating religion, but they're little better than those who wish for religious theocracy. No one ever has a right to say, "You must be here and leave your religion at the door."

A yarmulke or hijab or prayer beads are traditional religious accoutrements though. A mask is not.

Seems fine to me. If they're banning this, they'd have to ban all those cross necklaces too. There's a big difference between using school time for prayer and some kid wearing something with the word "Jesus" on it. Any amount of money would be too much though.
