This is sort of like the debate on Catholics "living in sin." So someone who commits murder can be admitted to communion because they are no longer doing that, but someone cohabiting with someone other than their spouse can be denied because they are still in the course of sinning. The result appears to be rather disproportionate punishments.

If you commit a crime where you are incarcerated with no other person to care for the child, the kid enters the system in foster care.

In this case, the children also have committed a crime. While we generally don't prosecute them because it is ultimately the fault of the parents, the children are in illegal status of the United States being released.

Uh, why would I expect the federal government to sit there and babysit my home and possessions while I am incarcerated for doing a crime? They aren't a nanny or sitter. If I was worried about my possessions and such, I probably shouldn't have committed a crime that put them at risk or had a better plan for how to care for them.
