This is sort of like the debate on Catholics "living in sin." So someone who commits murder can be admitted to communion because they are no longer doing that, but someone cohabiting with someone other than their spouse can be denied because they are still in the course of sinning. The result appears to be rather disproportionate punishments.

If you commit a crime where you are incarcerated with no other person to care for the child, the kid enters the system in foster care.

In this case, the children also have committed a crime. While we generally don't prosecute them because it is ultimately the fault of the parents, the children are in illegal status of the United States being released.

You know who are actually victims?

The kids who don't have fucking parents anymore because of a misdemeanor (illegal entry) because the government didn't even do the bare fucking minimum of keeping track of which kids went with which parents.

Incorrect. The United States is the victim. The illegal crossers of the border are the criminals. If anything, you are doing a good job of arguing that the crime should be more harshly punished.

Is it a fair process for immigration when a 3 year old must represent themselves in court? Or when Judges automatically deny claims, with bias?

Uh, why would I expect the federal government to sit there and babysit my home and possessions while I am incarcerated for doing a crime? They aren't a nanny or sitter. If I was worried about my possessions and such, I probably shouldn't have committed a crime that put them at risk or had a better plan for how to care for them.

Not my fault you are lacking with common sense regarding the issue.

You think that people arrested breaking the law with their children would then have their children released back into the breaking the law situation.
