Welp, last night's stream was spicy.

People were bringing all the inconsistecies to light about Phil's filing. Naturally he stuck his head in the sand. Bans a plenty, calling everyone idiots, saying that he didn't swear on the bible, that they were reading it wrong.

Then he started deflecting everything to his lawyer, throwing them under the bus.

If he really had a laywer, and they really proof read the application, it wouldn't have been submitted as it is now. So either he has no lawyer, or Phil went out if his way to find the cheapest there is.

But he still refuses to acknowledge the gravity of the situation, including the horrible application and what it might mean. He literally said it could all have been lies and nothing bad could come from it.

Oh, and he signed it on penalty of perjury. But, you know, no consequences.

Also, 50% of all Chapter 7 requests get denied, even if they are filed correctly.

But that is why it is so fascinating to me. Even now, the world around him is on fire. People are warning him of the mistakes he is making, confronting him with the errors so he might fix them in time. In stead, he adds MORE fuel to the fire, bans anyone who dares to say anything that goes against his world view.

Sure, there are trolls, but even those trolls are right. You don't have to be a fucking lawyer or expert on the law or bankruptcies to see the inconsistencies. A really fucking simple example is that he claims not to have a pet, but he does file 100 dollar every much for pet expenses.

And yes, if you make a few small mathematical errors, and you can work those things out with the creditors, that really isn't a huge thing.

But Phil has SO MANY inconsistencies on his application that there is no way anyone is going to take this at face value and go "oh, he made a small error here and there".

He lied about having a pet, he lied about having a business, he is filing all his expenses as business expenses. He is lowballing the value of his house so he can keep it under Chapter 7, so it can get exempt. He hasn't filed out HOW the debts came to be (which is a required part of the forms). There is no explanation what happens to his net income of 4000 dollars every month. He listed not having any electronics (fucking WHAT? how do you fucking stream without electronics?), not any collectibles, not having any property of value (like his CT condo), and all around trying to hide assets.

Now here is the thing, there is going to be a hearing with the creditors on the 5th of March. Phil will have to explain every single question shot at him. I mean, I am pretty fucking sure if we can see the inaccuracies, anyone doing this shit for a living can too. There will be no banning people, no silencing them. He will have to explain every single thing. This is going to make or (but likely) break his case.

If he is going to no show, his application is going to get discarded and he won't be able to file again for Chapter 7 for the next 8 years, but also won't be able to file for Chapter 13 for 4 years.

And one last thing I'd like to share: There is no fucking need for this. The whole bankruptcy is unnecessary. He seems convinced that every creditor is going to take the L, and Phil will be on his merry. But that is not how it is going to go. This whole situation can be solved in 5 years tops, if Phil would for ONCE would let his ego slide.

All he would have to do is sell the WAcondo, move back to CT (he has a perfectly fine home there). Use the money from selling the WAcondo to start paying off his debts. If the value of the house actually is around 450.000 (Phil is filing this for around 378k, so it can get exempt) minus the costs of selling it, he would make AT LEAST a dent in his half a million debt.

Then there'd be 100k left (at most) and then using his 4000k money he has to himself, make a fucking payment plan. If he'd go for 2500 per month (yes that is a lot, but that still leaves him to spend 1500 every month to himself, no strings attached), he'd be done in 40 months, so little over three years. Or he could go for a lower installment, and do it in five years.

Instead, this man is choosing (yes, choosing) to completely ruin his entire fucking life and is going to spit in the face of everyone trying to help him.

I am so SO looking forward to the 5th of March when he is going to meet with the creditors, and I am really curious to see if he is going to try and weasel out of it, or meet it head on.

Most of it will be publicly available. Every single court hearing for example. If the application gets accepted, it will be available, likewise if it gets rejected.

During the hearing on 5 March, Phil will have to explain his finances, this too will be publicly available so that an creditor not present during the hearing, can know what to expect.

That's the beauty that the justice system is funded by taxes, it's public money, so the public has a right to see what comes out of it, what happens with that money. Courts are public domain so to speak.

0%. I think Phil's right when he says his attorney can get the papers amended with any additioal information or corrections. As for losing his WAcondo, I don't see that happening either. The pig has gotten away with so much over the years I don't see this being as damaging as we may think.

Making amends costs money, and Phil did sign the papers on penalty of perjury. Sure, he may not have sworn in a bible, but the punishment for lying stands.

He is not going to jail for a simple reason: of that happens, the creditors get nothing. Phil more likely will get fined, but the point of bankruptcy is to work out a plan so that creditors get their money back. Especially since Phil makes over 6 figures a year.

The most likely thing to happen, in my humble opinion, is that Phil's application gets dismissed because of the inconsistencies, and the creditors get free game to move in to get their money, which includes selling his precious WAcondo.

Something that has become really painfully apparent with the start of the bankruptcy saga, is how Phil's mind works.

He doesn't lie to maintain up a charade of sorts, he lies of the sake of lying. He is well beyond pathological lying at this point. Everything is to protect his fragile little ego.

Yes there are enough trolls out there, trying to get a rise out of Phil. But there are also (why I don't fucking know) who genuinely want to help Phil. But no one know's shit, Phil is the only one who knows what's what. SO even if people are trying to help Phil, by pointing out inconsistencies on his application, his small mind isn't able to process him making an error.

We've all said and discussed it before, but whenever a fuck up happens on screen, the first thing that will come out of Phil's mouth that it is not his fault, that the game (he makes it sound like the game is some kind of sentient being, able to decide to fuck Phil over) took something back, showed something else on his screen or what not.

He doesn't lie to protect his family, he doesn't lie to keep the illusion that he is poor. He lies because it is literally all he can do. Everything is to protect his own ego. No one, even if they are well meaning, can help Phil. Because admitting you need help, would mean that Phil is wrong. This is why he can never accept help, because that would mean admitting he is wrong.

When people pointed out things about his application, he was struggling. Bullshit like "first filing" (this is not true), things can be amended (small changes). But lying on your application, withholding funds or trying to hide assets is frowned upon to say the least. Also, he said like he didn't swear on the bible or anything, though he signed the papers on penalty of perjury.

Phil will continue to scold everyone, even the people who mean well. Everyone is wrong. Phil will have instant knowledge of everything he Googled for 10 seconds. He is still responsible for how he filled out his application and his lawyer is only there to guide him through the process. But Phil naturally has thrown them under the bus already, because he is wrong already.

I suppose his self inflicted isolation hasn't done him any favours, but Phil has always been like this. His personality has always been present when you look through old footage. It's also not hard to imagine how he must be around his family/friends. Which in turn makes for a very plausible explanation why everyone broke off their relationship.

And Phil is also unable to process a situation where he will not come out on top. Best case scenario right now: Sell the WAcondo, move back to CT, make a payment plan for the remaining debt and in 3-4 years he is DONE.

If the bankruptcy goes through (this is an optimistic scenario) and this is by amending errors, he stands to lose his house. Period. His income combined with the worth of the house, mean they won't be exempt. Meaning they can get liquidated to pay of a huge portion of the debt. It might get turned into chapter 13, he will be able to keep the house then, but there will be a severe strict payment plan. Given the fact that his income isn't guaranteed (if Twitch goes tits up, he will only have his Youtube income, which is around 1k month at best). So he'll have to get a job to stabilize his income.

Absolute worst case scenario is that his application gets denied (very well possible given the current state), and the creditors can move in as they please. There will be no mediation or trying to work out a payment plan.

Something that caught my attention is the way Phil talks. He talks about all his money, all his possessions as being his, even though he is half a million dollars in the hole. Every cent he earns belongs to the creditors first, but he doesn't see it that way. Including his possessions, he doesn't see it as property of the people he bought it off, even though he hasn't paid it in full, he sees it as his. This is also why he believes that the bankruptcy is his golden ticket. He really believes that all other companies are going to take a huge L because he refuses to get his act together.

My one hope, and I know this is like hugely optimistic. But I hope this entire situation will humble him some.
