Yes, it is. It just depends on whether someone wants to press charges. Most of the time when kids pants each other they don't pull down the underwear too. They expose the underwear to cause the embarrassment. In this case, she allegedly pulled down both and exposed his penis.

There was a case in my town of a woman literally getting caught in the act of having sex with a 13 year old boy, who told police it was the fourth time she'd done it, as well as furnishings alcohol for the both of them, and she literally got away with it. Like she didn't have to spend a single day in jail or prison and didn't even get any probation. The actual molestation charges were dropped too so she isn't considered a sex offender and the one minor charge left on her record can be easily expunged in a few years.

The newspapers didn't even cover the story at all when it happened, they only wrote an article months later when she asked the court to seal the records of the case since she said her reputation was being harmed by the few people who had heard about it. The prosecutor on the case didn't even argue against the motion and it probably passed by now. Considering some guys have been given multi decade long sentences for similar cases, it really makes you think, huh?

To be fair, we've gone from that to self-identifying fluid gender queer complaining about filthy binary cis oppressors and people in Japan marrying anime characters, so maybe the conservatives were right all along and now we're slowly sliding into the End Times.

I'm not sure how you somehow think this is an excuse. Even overlooking that it's nowhere near as prevalent as you seem to think, there's a lot of things that kids do -- slapping people on the ass against their will, getting into shoving matches, trespassing, even groping, etc -- that obviously aren't appropriate even when they're kids and carry serious ramifications as an adult. Some people might think that a five year-old running naked through a supermarket is funny (mostly because his parents suck), but a twenty-five year-old doing the same thing is going to result in the cops being called.

And assault doesn't stop being assault because you meant it as a joke. Those two things aren't mutually exclusive. It can be a joke and still assault. The fact that you were trying to be funny doesn't magically make something right that's clearly wrong.

Not for kids no. I have my pants pulled own as a kid during P.E. Lucky I had boxers on that day. Was it embarrassing? Sure but it certainly wasn't "sexual assault". Just a prank. People tend to not give a shit when it's kids doing things anyway unless it's really bad.
