As far as merch goes, you have to look at how much is available for each person too. My wife really wants Becky and Charlotte stuff, but what's available for the two of them on the shop is pretty minimal. Compare that to someone like Roman and he has so much more gear, so the odds of finding something you like for Roman are a lot higher than finding something you like for someone that has 2 or 3 shirts. It's not difficult for them to manipulate sales numbers by what/how much they offer for each person.

She was a UFC fighter, ranked, on a 2 fight winning streak, and she had one fight left on her deal. They paid her (plus win bonus even) for that last fight without it ever happening, and then cut her.

Why? Because shes leading an effort to attempt to unionize MMA fighters.

So shes taking the matter to people who represent laborers to see what her chances are of fighting this in court.

Theyve told her theres nothing they can do, because UFC fighters are considered independent contractors, not employees. Sound familiar?

So she is taking the extraordinary step to get the courts to rule on whether or not it is fair for fighters to be classified that way.

CAN YOU IMAGINE the domino effect for wrestling if they rule in her favor? Would anyone from WWE take the leap to use that precedent to fight for labor rights in WWE?

The potentual downfall is that UFC has a more reasonable case to call their fighters that than WWE does for their wrestlers.

Except during the promotion period for a fight, UFC doesnt really control their fighters lives, outside of the reasonable expectation that they dont do anything criminal or damaging to the company, and they cant compete in other MMA promotions.

WWE obviously is a lot more draconian about controlling their wrestlers at all times

Huh, funny timing. I'm doing work for my job about independent contractor status.

Apparently the most persuasive decider for whether someone is an independent contractor is the right to control either the work to be done or in the manner of work to be done.

Unfortunately the case I'm working on is about truckers as independent contractors, so it's not quite as relevant (as a lot of the discussion is about government regulation). However, their wiggle room in this case was to claim they were actually independent contractors because their contracts allowed them to work for other companies, just with a ton of restrictions.

WWE and UFC wouldn't be able to make that argument and it would probably hurt their chances quite a bit.

While there is a line between autonomy with the performers, they are told essentially what they have to do and when in the vaguest sense and are required to show up for everything, so it's a toss up there.

Probably more damning is that they are paid a salary rather than pay-per-performance. If they were paid based on each time they performed, it would be more in-line with independent contractors since they would be independently doing work and get paid each time they do it (even if they were locked down to one business), but in WWE that's not the case. So they would be classified as employees in that sense.
