I really hope they don't win. The design is different enough, and the product satirical enough, that it really should qualify as parody. That is if the court even hears the case at all.

They do this in Wrestling all the time. Owning the character.. not the coming back from the dead. It is this guy named Scott Hall. When he was in the WWE he was called Razor Ramon. And his character was basically a copy of scar face. However when he went to another promotion he was not legally allowed to use that character. So it doesn't matter that Hall made the character famous , is the WWE came up with the idea they owned it .

This isn't typical but they even sent out new guy to say he was Razor lol. Most times that does happen, they just stop the actor from making money off of the character .

But WWE only had the rights to the name Razor Ramon, they couldn't block the character. So Scott Hall was able to go to WCW and pretty much change nothing except his name. WWE couldn't do anything about Scott pretty much uses the Razor character elsewhere, just that he couldn't use the name Razor Ramon.

Even in wrestling this has a fair bit of precedent, When the Dudleys, Christian, etc... went to TNA after leaving WWE they pretty much kept the same character but only changed the name. Some cases where they didn't even have to change their name (like the Hardys, Kurt Angle)

The last two people who tried to sue them for similar reasons (Lindsay Lohan and one of the mod wives) both had their cases dismissed. Basically they couldn't sue because it was a parody and they suing parties couldn't prove damages.
