Apparently it doesn't if both sides are acknowledging a gray area where courts haven't decided. And while you could argue that you might know better than DeVos (since she's barely been on the job), I'm *pretty* sure that those senators know what they're talking about.

Good, then she doesn't have to do it. She's the Secretary of Education. Her job isn't to determine what constitutes discrimination or to enforce discrimination laws.

There are a lot of private/charter schools now that get federal subsidies. She is actively trying to grow the practice. Because for profit education is the path to victory! /s

And she will do what the law requires - laws which should already cover discrimination. If they don't, then the issue is with congress and not the secretary of education.

Besides, even apart from legal definitions, this is specifically in reference to private schools. The beauty of private schools is that they're not compulsory. If I had an LGBTQ child that was being discriminated against, I would pull them out of that shitty school.

It might be a different story if this were in reference to public schools, but that wasn't the question that was asked.

I don't want my taxpayer money going to help raise a single mothers 3rd bastard child. If you can make sure this no longer happens I will support forcing private institutions to accept public business policies as per governmental decisions, since there will no longer be a federally subsidies subset of people who will affirmative actioned into the institution to ruin its educational integrity eliminating the current NEED for discrimination.

Look - she's a terrible pick for this position.

But she's answering the question the only way possible. If you receive federal funding - you have to follow federal rules. The grey areas have to be decided in court and law - they shouldn't be at her department's discretion. If it were - then it will just change administration to administration.

The problem is that we have kids insisting what discrimination is instead of having the courts examine the matter. The idea that kids are more qualified than courts is laughable, especially since the people sitting on the bench were, at one point, kids before they grew up, were highly educated, experienced decades of life, and sit there with a better understanding than laypeople on such matters.

Actually, the places where we invest the most tax dollars are the places with the highest levels of discrimination. Magnet schools being a perfect example. Granted, some of that is illegal but magnet schools are big into that.
