i was just telling this chick we weren't gonna pay for her claim because there was no foreseeability for the loss.

she had just told me before i said that that she hadn't had a chance to get an estimate because her daughter was sick and she couldn't drive her daughter all around.

after i told her we weren't going to pay she says "hold on, i'm gonna conference my dad in on this call!"

i asked her why?

she told me to just talk to him.

and instead of him actually listening to me he just started insulting me, obviously.

don't people get embarrassed by this? how are you mature enough or adult enough to raise a kid but you can't handle your own affairs?

it blows my mind

To be fair, you don't actually need to be mature OR an adult to have/raise a kid. Especially if you're one of the many, many people who are doing a somewhat piss-poor job of it.

But honestly, the entire concept of "adult" is blurred these days anyway. Legally speaking you're an adult at 18, but I can probably count on one hand the number of 18-year olds I've met in my life who I'd even remotely think of as being "adults" in terms of actual maturity or responsibility.

The Industrial Revolution was sociologically responsible for creating the entire concept of "teenager" as an intermediary phase between "child" and "adult". The modern Technological/Computer Revolution seems to turning the period between 18-25 or so into a new intermediary period of social immaturity and development prior to actual "adulthood".

to be honest, i don't really care. legally he's not even entitled to any information about the claim and i don't need to talk to your daddy about your property unless he's the owner. you'll never learn if you have your dad fight all your battles for you.

Well, see, if he's not entitled to said information, then that should've been your first statement to the daughter before she even got her dad on the phone (and then the first statement to the dad as soon as he got on the line).

You seem to be vilifying this girl for just asking for advice. It's not a big deal.

When someone starts yelling at me over stuff I can't control at work (like slow implementation team, IT issues, etc.), I just kick my feet up and pop on PotD or reddit while they get everything out of their system. Then when there's a lull, I recite the line that I've said a billion times, something along the lines of "I would help you if I could, but the only thing I can do is give you our support line."

Guy didn't deserve the time of day.

So is that like an act of God type of situation? No public liability for that? Also, if it had hit their own property, based on the policy they had, would they be covered?

what do you mean by public liability?

do you mean liability to damage to the general public? that's not really a phrase we use so i'm not sure exactly what you mean.

it'd be considered an unforeseeable event that couldn't have been avoided with a normal standard of care.

if it hit their own property their coverage should cover it but i don't handle first party claims so i don't know what their coverages are like. but the lady who sustained the damage has insurance but her deductible is too high for her to want to file a claim.

Thank you, Jen. Yes, that's what I mean.

It's just interesting. I mean, as an uninitiated person, I thought insurance was to cover incidents that you couldn't have prevented with a reasonable standard of care. Surely if an accident or event occurred which could have been prevented with a reasonable standard of care (eg, left your front door unlocked and got burgled), then the insurance shouldn't pay out.

Which makes me wonder, when insurance ever pays out in these cases. (Purely rhetorical and non-agressive - just thinking out loud. I know insurance companies pay out all the time, of course.)

you won't be saying that if you have a total loss house fire and a mortgage that still needs to be paid off.

insurance isn't a scam. it's a contract where you weigh your personal risk and the amount of your premium vs the limits provided and coverage provided to decide if it's worth it. the reason people think that insurance is a scam is being they don't read their own policies and remain ignorant to what it ACTUALLY covers under the misconception that insurance covers everything under the sun.

liability insurance actually does the opposite. liability insurance covers your negligent acts. we don't pay for pure accidents because they are unforeseeable and unavoidable and as such legally you wouldn't be responsible for something out of your control. we pay based on specific legal standards for whatever issue comes across our desks.

claims we pay a lot of: dog bites. we pay a TON of dog bite claims. we also pay a lot of claims on renters policies for grease fires because those are total negligence. what we don't pay for is something that you couldn't have prevented because it's not your fault.

now for your first party coverage on your own property and structures you don't have to be negligent for them to pay. they pay based on whether some is an accidental direct physical loss and if it's caused by a named peril which is defined in your policy.

i wonder why it's going to take a week

usually first party claims move pretty quickly.

but the adjuster should be able to tell you what's covered right now. just call and point blank ask them if it's covered and if they don't know what they need to know to determine if it is.
