Anyone who thinks the U.S. justice system is fair is nuts. It's also structurally biased in many ways. I voted straight "no" though, because while it's more unfair to some, there are ways in which it is unfair to all as well.

Depends on your definition of "fair." It's weighted in favor of the wealthy and influential -- which is the same of every justice system in the world -- and the sentencing is often insane, but generally speaking it's more than fair considering how many second, third, fourth, and fifth chances people tend to get. You had that one dude who was arrested 103 times (and is a registered sex offender) in the past 15 years before getting arrested for the 104th time for randomly attacking a pedestrian (and this is after multiple assault arrests this year). Can you imagine that shit happening in other nations?

Yes, the for-profit system designed to detain as many PoC (particularly men) as it can to use them as free labor while giving them as few trials as possible (and stealing people's property on the side through civil asset forfeiture) but shields the wealthy as much as it can is really fucking fair.

The very concept of a better lawyer means it's unfair. As long as anyone's skill comes into the equation, it can't possibly be fair.

The unfortunate reality is we just don't have the technology to be truly certain someone is guilty in most cases so we just go with if they are really likely to be guilty. If it was actually innocent until PROVEN guilty, most people would get away with their crimes because witnesses become meaningless cause they COULD be lying. Most physical evidence COULD be planted. Confessions are frequently false.

The prison system also inherently makes sentencing unreasonable because most crimes don't warrant even 1 day in prison where you might get murdered or raped or beaten.

On top of all that, it's corrupt too.

There's probably no completely fair justice system in the world but it is really shitty that people or companies with tons of money can pretty much strong-arm the system into getting their way and overpower their opposition simply because they don't have the money to fight them

Everyone should just be randomly assigned a tax-funded lawyer, rather than personally paying them. Adjust those lawyers' salaries based on how many cases they win (presumably with some further nuance than that) so there's still an incentive to be competent, but take away the wealthy's ability to rig the justice system by affording better lawyers.

Of course, "random" has a lot of room for manipulation and corruption, but that's not impossible to sort out.

Should also mention being judged by a jury of your peers doesn't sound super enticing when you look at the average american. In an ideal system, there wouldn't lawyers or a jury, but the technology isn't there to support much of anything else so for now its all about if you can pay someone to convince strangers you probably didn't do it.

I've considered this. I've known multiple people on juries for serious crimes and I'm like, "man I would not want this dude on my jury"

It wasn't "homework," it was schoolwork. She hadn't been participating in her online classes. And she's not "jailed," she's in a youth detention facility where, among other things, she's doing her online classes and -- according to the article -- she's been doing much better in school. This one was all spelled out right in the same article you didn't bother to read, which makes the shocking headline seem like a nothingburger considering kids who skip school already can wind up in juvenile detention facilities where they're also educated.

And it turns those "child sex abuse" charges were related to child porn and the minor in many (or possibly all?) of those photos turns out to be his now-wife who was 17 at the time (and is now 19). There was a secondary accusation about he and an 11 y/o allegedly raping a 14 y/o, but another article suggests those charges weren't part of the plea bargain so either it's going to be a separate case or it was dropped (that part was unclear in the initial article, but it makes sense because it's unlikely that somebody is going to get 1 year and a deferred sentence). Oh, and by the way, he SERVED more than a year in prison and some of that time was credited against his sentence, which is likely why it's lower.

It's easy to say "no" without any specific changes that I actually think would make it better, so I vote last.

Seems like the only way to fix the crazy outlier cases would be to make a stricter rulebook... but then the crazy outliers would be in the rulebook. Dictator Democracy problem. Crazy voters? Dictatorship. Crazy dictator? Democracy.

Oh, and the obvious "we lock up people for doing drugs" part of course.
