There is no way he can plead temporary insanity if that is what you mean. It's not like he snapped for an evening and comitted a horrible crime.

He has been building up debts for years, and every time he had a win-fall (Emerald 7, Tut, etc) he decided to blow the money on himself. Every thing he has ever done, ever penny spent was highly ill advised, but not malicious. Stupid, yes. But not because a mental handicap that renders him unable to function like an adult.

He just refuses to take responsibility, and that defense is going to get destroyed. He is actively trying to hide funds by increasing his business expenses for example in July last year. This is calculated, a conscious discussion.

I was thinking more along the lines of mental impairment so he can't form the mens rea (guilty mind) at the time of the crime in an act of desperation.

Does DSP take you as the type of dood who will accept legal suggestion to take an insanity plea? I doubt the indent is admissible, but something to think about.

That's nothing, earlier this week (and it happened before), he was upset at having to contact someone by phone, but could only do so during business hours. This greatly inconvenienced Phil, because it clashed with his streaming schedule.

Again, I honestly don't see this happening. I was joking about being an asshole, but narcissism is actually in the DSM-V. But it is not considered an impairing mental illness in comparison to let's say autism, and not even all forms of autism make a person unable to lead fulfilling meaningful lives, it's a spectrum, and so is narcissism really. Some people might experience problems with sympathy, empathy, introspection etc and it all happens in varying degrees. But at no time has Phil made (nor will he make) an impression that would render him incapable of making "adult" (to use Phil's own words for once) decisions.

Yes, it's going to be harder for some people dealing with "normal" situations that others might not (for example, I have Asperger's I have the hardest fucking time for example making eye contact, so if I fail to do so at let's say a job interview, I can make a really poor impression. Is it unfair that I get treated like I fucked up? Maybe, but it's not fair for me to expect everyone in the entire world to accommodate me, so I do have to "work harder", but I am sure as fuck not exempt from my actions). So yes, Phil might have a harder time trying to be introspective, or showing empathy, but he is not exempt from the consequences of his actions.

Were his actions ill advised? Oh fuck yes, he believed that he could ride the Youtube gravy train for years to come. So while that DOES show he lacks foresight, what's more damning is the fact that when the money was drying up (not that he is making peanuts now, fuck that), he refused to adjust and kept spending more money than he was actually making is something that is going to be held against him.

Phil has been able to weasel his way out of lot's of situations and his luck has gotten him pretty fucking far. But this time, there are actual consequences to what Phil has done, the hens have finally come home to roost and he will have to explain why he has spend money the way he did. And lack of foresight, narcissism or not, is not going to be a valid excuse. That he doesn't feel bad for what he has done (lack of guilt) isn't going to work either, because in the end it's about the math. You cannot spend 150 dollars if you only have 100 dollars. Just because he doesn't feel guilty about doing it, rationally speaking, you know that the number just don't add up.

So no, I am convinced Phil isn't going to weasel his way out of this one, because the creditors aren't going to take any bullshit, and his lawyer should have otherwise made a case that Phil would have been unfit to handle finances.

One thing that also caught my attention, Phil once again shifted the narrative. For the last 2-3 weeks he kept saying that he wasn't going to lose the house. Now for the last week he has been saying he isn't going to jail. My guess is that was saying that to reassure himself. But he may have come to realize that losing the house might now be a real possibility, so he can't reassure himself with that anymore. However, it is indeed very VERY unlikely he will end up in jail, so he is now saying that to reassure himself.

I understand where you are coming from, but you have to take into consideration that Phil is deliberately trying to fuck with the numbers in order to keep his house. He signed it under the "penalty of perjury", if he was unfit to make these kind of decisions, then he wouldn't have been allowed to fill out these kind of forms by himself.

And I am really trying not to "arm chair diagnose" here, but other than Phil's apparent narcissism, there really isn't anything (other than being a douche canoe) that would let Phil qualify for an insanity plea. My knowledge of the law is limited, and I am not from the US, but looking at this logically, I just don't see it happening that there are circumstances that would let Phil off the hook.

He is a consenting adult, made his own decisions, runs a business, has credit cards, owns 2 houses. All these things would not be able if he was "insane" or "unaccountable" for his actions.

I understand why you would worry, given Phil's track record. But these are not his followers he is going to try and manipulate, this isn't going to be a vacuum where the truth is whatever the fuck Phil wants it to be. He doesn't have anyone covering his ass like he has on Twitch and Youtube.

I remember people telling Phil to get a job (prior to his mom telling him) and he would call them stupid and trolls. Once his mom told him it's time, he said she was right and it was difficult to hear. Never apologized to the "trolls" for giving him this advice years earlier.

Sure, getting a job would be ideal, but this is Phil we're talking about here. For a crime to qualify as a crime actus reus (guilty act) and mens rea (Guilty mind) have to have been together. An example of this is something I brought up with my instructor, who is a lawyer in class. Say some girl gets up in her car with full intent to murder another girl - gun on the dash, tape, mask, the works. However, she ends up "accidentally" running her over on the way to her. It's nuts, but legally you can only at most charge with manslaughter, not murder as at that time the two weren't in synch.

I recall bringing up the "But for" rule where essentially the order of events leading to her death would not have set in motion had the crazy bitch not got up in the car in the first place with the intent, but then all of us, him included were taken for a loop in that little discussion. lol. I don't think he wants any part of that case on either side.

I'm a fantastic worker, but I can't ever get jobs because I always bomb them because I not only do I have a hard time talking and making contact with people, but I'm also depressed and have a very hard time saying good things about myself. For example, why I would be better at this job than someone else. I'm very timid, but I'm a fantastic worker. I'm just not one for small talk

I am fascinated too and I am trying to be cautiously optimistic, but we know for a fact that Phil's usual MO isn't going to fly in court, because he won't get absolute control over the narrative.

Even if an employer didn't know who Phil was, how long would he actually last at a job? Welp, we all twisted the "going to jail" pity party. See, Phil never said he was at risk of going to jail, he said that not filing your taxes could result in jailtime.

There was a 500 dollar tip goal, for Phil just jerking it to old "content", and a subgoal that need to be paid for, what the fuck... There is no universe that this warrants 500 dollars.

Phil got 520+ dollars in tips.

He made over 800 dollars just watching himself. I don't have any words to convey any rational thought or emotion. This is exceptional beyond reason.

It was an all round boring stream, Phil was boring and only watching himself (true to his narcissist self anyway), and he got rewarded for it.

It may seem like it takes no effort, but the majority of streamers (at least) are talking/engaging with their chat for 6+ hours a day, which is not something that is super easy. Phil is anything but engaging with his chat, though, so it's pretty much Phil turning on the stream, talking about his finances for an hour, then "playing" the game for 2-3 hours. As someone who watches quite a bit of Twitch, Phil does the absolute fucking minimum for his streams.

He is also f***ing awful at DK64. Trying to savestate through a mini game and rushing through something that looks like a maza, but hurts you when you touch a wall. Is angry at the devs (shocker) and says that the only way to get through it is by abusing savestates.

The first thing that comes to my mind as an actual highlight of Phil being good at the game is when he managed to beat Mz. Ruby on his first try (though he was damaged by Mz. Ruby's shockwave when he got to her the first time around, and in an uncommon example of Phil actually experiencing a game bug, stayed under the water after being damaged until he jumped up to the water's surface) during his first playthrough of Sly Cooper. The second time around however, he died once to Mz. Ruby.
