This streamer was apparently doing a livestream with a mic setup in public to play whatever sounds his donors wanted to play through Alexa (for most of his stream it was stupid awkward/cringy stuff). Seemingly unbeknownst to him, a donor played a fake bomb threat message that sent a classroom into a temporary panic. He was subsequently arrested and is now facing criminal charges.

To whom do you ascribe more blame to, and who should be facing the criminal charges?

Why do you place legal blame on the streamer, though? It seems odd to me given that he didn't violate any law by just streaming other people's lines. Getting reactions is not tantamount to making fake bomb threats. I 100% see this as only the donor being legally responsible.

The streamer was stupid, but stupidity really isn't on the same level as the donor deliberately trying to cause a panic. They're not equally responsible, but I would not call the streamer blameless, either.

I don't really see how any blame can be placed on him. All he did was provide a speaker that people could use. He should probably have screened content to prevent something like this from happening, but I'm pretty sure that's more of a common sense responsibility than a legal one.

Unless, of course, he did screen it and decided to play it anyway. Then they should be charged equally.

The streamer should maybe be fined for causing a public panic but he shouldn't go to jail. Even though he didn't really handle the situation well. Should have told people not to panic and apologized. Especially since the dude is arabic looking, like being a white person and saying anything racist, even in jest, can have horrible consequences. Certain ethnicities have to walk on eggshells with certain situations, this was one of them. I just hope someone realizes this before the poor dude goes to some prison for terrorists.

Both are responsible. Arguably, the streamer should probably be charged with negligence (since intent was lacking) while the donor should be charged for the actual bomb threat (since the intent was there), but neither should be walking away from this consequence-free.

That is definitely debatable, since there's a real question of how responsible he is for what other people say over his speakers. If he was handing random people a megaphone and one of those people yelled "Fire!", should he be held liable for the ensuing panic? Most would say no. This situation isn't really that different. Here, he has the potential to screen things before they're broadcast, which he (presumably) didn't do, but does having that ability mean he's required to exercise it?

There have been cases of community service applied to people for disorderly conduct and similar non-criminal activities.

There was this lady who entered a Starbucks and started screaming at the top of her lungs at the cashier. She was detained by cops, and released an hour later since there was no crime, she was just crazy lol.

A judge ought to throw the law book at him. We need to come down hard on incidents like these where jackasses pull dangerous stunts like this to make quick bucks off others who want to be entertained. Leniency on stuff like this should be for those who are in actual paychological distress.

True, but I am also glad the dude isn't going on a terrorist watch list. Glad humanity didn't fail. But he sure as hell should be sued by everyone, in one big lawsuit of course. So he gonna be paying them money for the rest of his life. Me personally I would have heard the C4 planted part and I would have burst out laughing. But I don't think anyone heard that, also the voice was way over the top. But some people took it very seriously and honestly thought they were about to die and become another terrorist victim. So yeah, even though he shouldn't face jail time, he owes them a life debt payed for in cash and community service. Not every crime needs a jail sentence.

That does give him quite a bit more culpability, then, and he's an ass. That said, I'm still not sure how much blame he personally deserves. All he's doing is giving a platform to the people that are actually causing the problems. Would it not make sense to let him continue, but criminally prosecute everyone who uses his platform to commit a crime? His stream would die pretty quickly in that case without anyone having to intervene specifically, plus it'd allow a number of troublemakers to be suitably punished until they clued in that leaving a digital paper trail behind a bomb threat is a bad idea.
