By my estimation of the court's thought process, without actually reading the opinion, the primary issues regarding education are: 1. As opposed to other rights in the Bill of Rights, this would be a positive right in that it would force government to do something as opposed to preventing government from doing something. This is rare with regards to the protections provided through the Constitution, if not in outright contrast to existing protections. I'm too lazy to do an in-depth analysis at the moment to verify that previous sentence if there are positive rights protected by the Constitution, but nothing jumps out at me at first thought. 2. Even if the Constitution provided positive protections, the "right to an education" is too far removed from the usual cavalcade of life/liberty/property interests protected by the Due Process Clause, which would really be the only avenue to assert such a right. The problem with this approach mirrors the aforementioned: the Due Process Clause is a negative right, as it prevents government from infringing upon one's right to life/liberty/property without due process of law. No other amendment could reasonably be stretched to such a degree, and it's generally recognized that education is primarily a matter for the states' concern, with the federalis playing a support role. 3. The extent to which the U.S. Supreme Court would be willing to extend such a right (based on existing case law) to education would mirror the Court's analysis under the "fundamental interests" protected by the Due Process Clause: the right of access to the court system and to the ballot. This is easy to understand because it fits into a reasonable (loosely speaking, of course) mindset of a leader that believed his grip on his absolute power was tenuous and constantly at risk of undermining. The killings were also more organic (which doesn't make it any better, obviously) in that they fell within standard methods: shootings (both clandestine and execution-style), starvation, and abuse via conditions. In contrast, the final stages of the Final Solution were cold, meticulous, separated, and industrialized. It ceased to be a struggle for Hitler to remove his political enemies (quite early on, actually), and instead was a process purely geared towards purging huge swathes of people strictly because of their heritage or abnormalities.
