It is a delicate balance to strike for judges.

If they make it too easy for the abused, then anyone can just say "I was abused" in a matrimonial dispute to screw the other side.

On the other hand, it is often quite hard to prove something that happened if you do not have evidence other than your words (keep in mind physical injuries could and have been faked by people in the past). Most judges are aware of this barrier.

Most of the time, it comes down how the judge feel that day and which side (or their lawyer) is more persuasive/sympathetic. Not ideal, but what can you do.

That's what legal briefs are for. Appeals are not like trials. It is very rare for a judge to be persuaded and change his or her position on something said during oral arguments, because such statements should have already been argued, developed, and fleshed out in the parties' legal briefs.
